fa کاربرد عرف در مقام تفسیر در حقوق قضایی مبتنی بر مبانی فقه امامیه حقوق خصوصی Pivate Law پژوهش كاربردي Applicable Research <div style="text-align: justify;">چکیده فارسی:<br> <em><span style="font-family:b zar;"><span style="font-size:10.0pt;">عرف چه در سنخ قولی و چه در سنخ عملی و فعلی در قالب عادت و رسوم معمول در میان مردم متجلی می‌باشد عرف در هر مکتب حقوقی می‌تواند در سه مقام ایجاد قواعد حقوقی، مقام تفسیر و تطبیق قواعد حقوقی، نقش بسزایی را ایفاء می‌کند (علی‌الخصوص مبتنی بر مبانی پوزیتیویسم حقوقی) اما سوال اصلی آن است که استناد به عرف در مقام تفسیر با چه اصول و راهبردهایی باید انجام شود تا بتواند تضمین‌گر عدالت در اجتماع باشد؟ به نظر می‌رسد قاضی به عنوان مفسر قانون جهت تطبیق احکام و قواعد حقوقی بر موضوعات خارجی (مصادیق) ناگزیر از شناخت عرف‌های زمانی و مکانی، قولی و عملی، عام و خاص مقام تفسیر و تطبیق قواعد حقوقی است . در مقام تفسیر قاعده حقوقی، شناخت واضع صالح و موضوع‌له مد نظر مقام واضع در تفسیر واژگان و عبارات قانونی نقش بسیار مهمی دارد که در بسیاری از مواقع این عرف است که واضع است و معنای مد نظر عرف تعیین کننده مراد قانون است (چه در تعیین دایره موضوع و چه در تعیین مفهوم حکم) در نتیجه تعیین حیطه حاکمیت حقیقت عرفیه در تفسیر نیز در کنار حقیقت قانونیه و شرعیه از جمله مواردی است که می‌تواند لزوم ارجاع به عرف را به عنوان یک مقدمه واجب، برای قاضی حکم نماید لذا در مقام تفسیر می‌توان فرض وجود حقیقت عرفیه، قانونیه و شرعیه را برای یک واژه نمود و آنچه راهگشای قاضی خواهد بود تعیین حیطه هر یک از موارد مذکور در مقام جعل و وضع است.</span></span></em></div> <div style="text-align: justify;">Abstract:<br> The custom Both orally and practically is the usual habit and behavior of humans. Cstom in any legal school of thought can play a significant role in three area: creating legal rules interpretation of legal rules and enforcement of legal rules (particularly, based on the legal positivism foundations) But the main question is that the reference to custom in order to interpretation should be done By what principles and strategies to ensure justice the community. It seems that it is inevitable for the judge as an interpreter of the law to apply the legal rules to facts of the case. through the recognition of temporal or local, oral or practical and general or special customs. In the process of interpretation of a legal rule, an important role should be given to the recognition of the competent athority who laying down the rule and also the subjects of law or law followers. In many cases, such a custom is laying down the rule and intention of the legal rule is the customary meaning of the text ( both in Determining the legal rule and the facts of the case). As a result, determining the scope of the costomary truth along with the legal truth is a base that may athorize the judge referring to the custom as an obligatory necessity.
