fa ارتباط مسئولیت انتظامی با مسئولیت کیفری و مدنی حقوق عمومی General Law گردآوری و مروری Revision & Collection <div style="text-align: justify;"><span style="font-style:normal;"><span style="font-family:b compset;"><span style="font-size:10.0pt;">علی‌رغم اینکه در تحقیقات و تألیفات حقوقی به مبانی، احکام و اصول حاکم بر مسئولیت مدنی و کیفری و نیز خسارت ناشی از جرم جرم پرداخته شده است، مسئولیت انتظامی یا انضباطی در کنار این دو نوع مسئولیت حقوقی مورد توجه چندانی قرار نگرفته است و اشخاص درگیر با آن، به‌ویژه مراجع رسیدگی‌کننده به تخلفات انتظامی، در این ابهام اساسی‌اند که در رسیدگی و نیز تعاریف و تعیین دامنه احکام مرتبط، تابع مسئولیت کیفری یا مدنی باشند. مسائلی از قبیل ارکان تحقق تخلف، عوامل رافع مسئولیت انتظامی، نقش عنصر معنوی در وقوع تخلف و نیز سایر قواعد و اصول دادرسی در رسیدگی</span></span></span><span style="font-style:normal;"><span style="font-family:sakkal majalla;"><span style="font-size:10.0pt;">‌</span></span></span><span style="font-style:normal;"><span style="font-family:b compset;"><span style="font-size:10.0pt;">های انتظامی موضوعاتی‌اند که با تبیین و تعیین آن می‌توان مسیر مراجع رسیدگی‌کننده به تخلفات را تسهیل کرد. بر همین اساس در این مقاله ضمن ارائه تعریفی از مسئولیت‌های حقوقی، به بیان تفاوت‌های بنیادین مسئولیت مدنی و کیفری با مسئولیت انتظامی خواهیم پرداخت و در نهایت نوع سوم از مسئولیت تحت عنوان </span></span></span><span style="font-family:b compset;"><span style="font-size:10.0pt;">&laquo;مسئولیت انتظامی&raquo;</span></span><span style="font-style:normal;"><span style="font-family:b compset;"><span style="font-size:10.0pt;"> با احکام و آثار و قواعد مختص خود اثبات می‌شود.</span></span></span></div> <div style="text-align: justify;">Despite the fact that in investigations and legal writings enough consideration has been paid to the founding principles and rules governing civil and criminal liability as well as damages of crime, the legal or disciplinary responsibility accompanying these two types of legal responsibilities has not been taken seriously into account and the people involved it - in particular, the authorities dealing with violations of law and order- remain in this fundamental ambiguity:&nbsp; in the proceedings, as well as in the definitions and identifying the scope of the relevant judgments, should they follow the criminal or civil responsibilities? If we try to clarify and solve some important issues such as the fundamentals of identifying violation, the factors of evading legal responsibility, the role of the spiritual element in the occurrence of the violation, as well as other rules and principles of law enforcement in legal investigations, we can help the authorities who investigate the violations to take a right direction.
