fa مبانی و برخی از مصادیق پذیرش عرف تجاری فراملی در حقوق ایران حقوق خصوصی Pivate Law تحقیقات بنیادی یا نظری Research <p dir="RTL" style="margin: 12pt 0cm 8pt; text-align: justify; line-height: normal; unicode-bidi: embed; direction: rtl;"><span dir="RTL">عرف تجاری فراملی، جزیی از حقوق عرفی بازرگانی و مهم ترین منبع قاعده ساز آن است که مبتنی بر رفتارها و رویه های تجاری ثابت و تکرار شده می باشد، علیرغم پذیرش و اعمال عرف تجاری در روابط بازرگانی، ابهامات حقوقی نسبت به ماهیت، نحوه استناد، شناسایی</span> <span dir="RTL">و مبنای الزام آور بودن آن به عنوان قاعده حقوقی در رویه محاکم داخلی وجود دارد.</span> <span dir="RTL">از آنجایی که در تجارت بین الملل قانونگذاری بین المللی وجود ندارد نقش عرف تجاری که در عرصه و رسته های مختلف تجارت شکل می گیرد برجسته تر می شود</span>.<span dir="RTL"> انعکاس عرف تجاری فرا ملی در کنوانسیون ها و اسناد بین المللی، باعث رفع تردید ها در خصوص اعتبار و الزام آور بودن آن شده، و تمایل به پذیرش و اعمال مقررات عرف تجاری در روابط بازرگانی افزایش یافته است. در نظام حقوقی ایران و رویه محاکم داخلی استناد به عرف و مقررات شناخته شده متداول تجاری و اعمال آن بر اختلافات در روابط تجاری مورد توجه قرار گرفته، همچنین در قانون مدنی امکان استناد به قواعد عرفی و قانون مرضی الطرفین در موارد خاصی به رسمیت شناخته شده است، که می تواند مبنایی برای توسل به عرف تجاری فراملی به عنوان قانون منتخب حاکم بر اختلاف از سوی محاکم داخلی باشد. از سوی دیگر پذیرش عرف بازرگانی فراملی را می توان در نظام حاکم بر روابط تجاری به روشنی یافت. در پژوهش حاضر خصوصیات عرف تجاری فراملی، مبانی حقوقی پذیرش و اجرای این قواعد عرفی و رویکرد رویه قضایی نسبت به این موضوع بررسی خواهد شد.</span></p> <div> <p style="margin:0in;margin-bottom:.0001pt;background:white"><span style="font-size:10.0pt;font-family:"></span>Transnational trade usage is the most important source of international commercial law which is based on the course of conduct and practices.<br> Despite the acceptance and application of trade usage in commercial relations, there are some ambiguities regarding its nature, identification and its binding force as a legal rule in national courts procedure. Lack of an international legislative body in international commercial law strengthen the stand of &nbsp;trade usage&nbsp; as source of law.<br> Today, reflection of the transnational trade usage in international conventions and documents has reduced doubts about their credibility and reliability; hence, tendency to accept and enforce the rules of trade usage in commercial relations has increased.<br> In Iranian legal system and practice of national courts, reference to and application of trade usage and Lex moratoria in commercial case have increased. Also in civil code of Iran, it is possible to refer to the trade usage as applicable law and agreed by the parties to a contract. This statement could be a legal base for resorting to trade usage as the law governing the dispute by courts.
