fa واکاوی نقش قراردادهای هوشمند در توسعه نظام ثبت الکترونیکی اسناد حقوق خصوصی Pivate Law پژوهش كاربردي Applicable Research <div style="text-align: justify;"><span style="font-style:normal;"><span style="color:black;"><span style="font-family:b compset;"><span style="font-size:10.0pt;">نظام ثبت اسناد یکی از مهم‌ترین ابزارهای لازم برای تضمین حقوق اشخاص و پیشگیری از اختلافات است. در بسیاری از کشورهای توسعه‌‌یافته تلاش شده است تا با ایجاد تحول در این عرصه، زمینه تسریع و تسهیل ثبت اسناد فراهم شود. کشورهایی نظیر امریکا و انگلستان، نه‌تنها با وضع قوانین جدید از نظام ثبت سنتی به ثبت الکترونیک تغییر وضعیت داده‌اند، بلکه با بهره‌گیری از فناوری‌های جدید، نظام ثبتی نو با استفاده از قراردادهای هوشمند در بستر بلاک چین پایه‌ریزی کرده‌اند. در ایران هرچند با وضع قوانین جدیدی نظیر قانون کاداستر تلاش شده که ثبت الکترونیک بیش‌از‌پیش توسعه ‌‌یابد، اما استفاده‌ از روش‌های ثبت نو در بستر بلاک چین با بهره‌گیری از قراردادهای هوشمند، نیازمند زمینه‌ها و زیرساخت‌های فنی و حقوقی لازم است. قراردادهای هوشمند، قراردادهایی الکترونیکی هستند که شاخصه‌هایی منحصربه‌فرد مانند امنیت، نظارت، بازده مبادلاتی، بی‌‌نیازی از دخالت واسطه‌‌های مالی و مراجع قضایی نسبت به سایر قراردادهای الکترونیکی دارند. پیاده‌سازی فرایند انعقاد این قراردادها در حقوق ایران نیازمند توجه به چالش‌های این حوزه، از جمله نحوه احراز زمان و مکان انعقاد این قراردادها، چالش‌های مرتبط با عیوب اراده، نظام مسئولیت و نظام پذیرش خطر است. حل این چالش‌‌ها می‌تواند پذیرش این قراردادها در حقوق ایران را هموارتر کند. در این مقاله تلاش شده است با استفاده از آخرین آثار علمی منتشر شده و بررسی وضعیت فعلی نظام حقوق ثبتی ایران، ظرفیت‌ها، بسترها، چالش‌ها، نواقص، نارسائی‌ها و راهکارهای موجود بررسی شوند.</span></span></span></span></div> <div style="text-align: justify;">The document registration system is one of the most important instruments for guaranteeing the rights of individuals and preventing the occurrence of many disputes. In many developed countries, attempts have been made to change the system of registering transactions and documents. Thus, countries like the United States and Britain have changed the status of electronic registrations by adopting new laws, and by use of new technologies, have recreated the new registration system using smart contracts in the block chain. Although new laws such as the Cadastral Law have been approved in Iran, and electronic registration has been developed more widely, but the use of new registration methods in the block chain with the use of smart contracts requires the development of technical and legal contexts and infrastructure. Smart contracts are electronic contracts that have unique features such as security, supervision, transaction efficiency, and the need for financial intermediaries and judicial authorities to interact with other electronic contracts. Implementation of the process of concluding these contracts in Iran&#39;s law requires attention to the challenges in this area, including how to determine the time and place of concluding these contracts, the challenges associated with defects of will, the system of responsibility, the system of risk acceptance. Solving these challenges can make these contracts more effective in Iranian law.
