fa از حقوق بشر تا حقوق شهروندی؛ از فاعلیت تا مشارکت تحقیقات بنیادی یا نظری Research <div style="text-align: justify;"><span style="font-style:normal;"><span style="font-family:b compset;"><span style="font-size:10.0pt;">در چارچوب حق‌های بشری، می‌توان با تکیه ‌بر معنای &laquo;فاعلیت هنجاری&raquo; از مفهوم مبهم کرامت ذاتی پرده برداشت و بر مبنای نقش حق‌های بشری در پاسداری از &laquo;شخص بودن&raquo; انسان، به‌سوی فهم چیستی حق‌های بشری و تعیین مصادیق آن راهی گشود. همچنین در چارچوب حقوق شهروندی با تکیه ‌بر اهمیت نقش سیاسی متمایزکننده‌ی افراد جامعه در شکل دادن و حمایت از زندگی جمعی، آن‌ها می‌توانند شرایط حاکم بر زندگی اجتماعی را به شکل برابر تعیین کنند. این موقعیت، نه‌تنها حق برابر به ‌منظور بهره‌مندی از خیرهای جمعی ناشی از مشارکت سیاسی را تضمین می‌کند؛ بلکه تکالیف برابری را به‌منظور حمایت و تقویت آن‌ها در برمی‌گیرد. در این رابطه، شهروندی &laquo;حق بر داشتن حق‌ها&raquo; را شکل می‌دهد و از این منظر که این توانایی را به خود شهروندان واگذار می‌کند تا تصمیم بگیرند خواهان چه حق‌هایی هستند و چطور اعمال می‌شود؛ متمایز از حقوق بشر تلقی می‌شود.</span></span></span></div> <div style="text-align: justify;">Within the framework of human rights, one can conceive of the vague concept of inherent dignity on the basis of the concept of &quot;normative subjectivity &quot; and, on the basis of the role of human rights in protecting the personality, one can find a way for understanding of what human rights are there and what is their its implications. In contrast, within the framework of the rights of citizens, based on the importance of the distinct role of citizens in shaping and protecting collective life, citizens can determine the conditions governing social life equally. This position guarantees not only equal rights in order to benefit from the collective goodness provided by political participation, but also include equal duties in order to protect and strengthen them.
