fa چالش‌های فراروی دادرسی الکترونیک در ایران حقوق کیفری و جرم شناسی Criminal Law پژوهش كاربردي Applicable Research <div style="text-align: justify;"><span dir="RTL"><span style="color:black;"><span style="font-family:b zar;"><span style="font-size:12.0pt;">با توسعه فناوریِ اطلاعات و ارتباطات، لزومِ حضورِاصحاب دعوی و استفاده از کاغذ در بخشی از فرایند دادرسی کاهش ‌یافته است. با اینکه دادرسی الکترونیکی دسترسی آسان همگان به عدالت و کوتاه شدن مسیر دادرسی را میسر می‌سازد اما این نوع دادرسی با چالش‌های متعددی روبرو است. پژوهش حاضر از نظر هدف، کاربردی و از نظر روش، توصیفی- تحلیلی است درصدد بررسی چالش‌های حقوقی و اجرایی فراروی دادرسی الکترونیکی در ایران. نتایج تحقیق حکایت از آن دارد که کاهش هزینه‌ها و تسریع دادرسی، رهاورد ظاهری ورود فناوری اطلاعات به مراجع قضایی بوده است همچنین میزان فناوری نوین با اصول دادرسی عادلانه، ازجمله اصل برابری اصحاب دعوی، اصل مواجهه، علنی بودن دادرسی و ... مورد بررسی قرار می‌گیرد. در کنار این&rlm;ها چالش‌های اجرایی نظیر: فقدان امنیت سایبری، پایین بودن فرهنگِ الکترونیکِ قضایی و ... ملاحظه می&rlm;شود که البته می‌توان با ارتقاء امنیت سایبری لازم، توسعه دادرسی الکترونیک (بدون محدودیت زمان و مکان) و نیز ارتقاء آموزش و فرهنگ‌سازی نسبت به رفع چالش‌های مذکور اقدام کرد.</span></span></span></span></div> <div style="text-align: justify;">With the development of information and communication technology, the need for the plaintiffs and the use of paper has decreased in the process of proceedings, but this type of trial has many legal and executive challenges. The present research in purpose view, applied and in terms of methodology is descriptive-analytic which seeks to analyze the legal and enforcement challenges of electronic justice in Iran. The results of the study indicate that the cost reduction and accelerating the process of trial are the results of the appearance of information technology access to judicial authorities which against this level, the degree of its opposition to the principles of fair trial, including the principle of equality of the parties, the principle of confrontation, the openness of the proceedings, and ... are examined and beside that, there are executive challenges, such as the lack of cyber security, the low level of electronic judicial culture and so on.
