fa عزاداری‌های نامتعارف در پرتو حقوق کیفری و رویه‌ی قضایی ایران حقوق کیفری و جرم شناسی Criminal Law تحلیلی و انتقادی Critical & Analisis <p dir="RTL" style="margin: 0in 0in 10pt; text-align: justify; unicode-bidi: embed; direction: rtl;">در جوامع اسلامی و به خصوص در میان شیعیان و با استناد به لزوم احترام به شعائر الهی، عزاداری برای پیامبر و اهل بیت ایشان به عنوان مصداقی از شعائر الهی، امری نیک و پسندیده تلقی می&shy;شود اما عزاداری‌ها نیز مانند بسیاری از مسائل اجتماعی و مذهبی دیگر دارای طیف گسترده&shy;ای از تفاسیر و مصادیق هستند به‌گونه‌ای که برخی از عزاداران اقدام به انجام رفتارهایی مانند قمه‌زنی، تیغ‌زنی، قفل‌زنی، راه رفتن بر روی آتش و زغال گداخته، غلتیدن بر روی خرده شیشه و... می‌‌کنند و این رفتارها را مصداق واقعی عزاداری می‌دانند. از سوی دیگر بخشی از دستگاه عدالت کیفری بر این عقیده هستند که بایستی با ابزارهای کیفری با این نوع از عزاداری&shy;ها برخورد نمود؛ در این پژوهش به شرح و نقد سیاست تقنینی و قضایی ایران در این رابطه پرداخته خواهد شد و این امر به اثبات می&shy;رسد که هیچ محمل قانونی جهت برخورد کیفری با اینگونه از عزاداری&shy;ها وجود ندارد.<br> &nbsp;</p> <p style="margin: 0in 0in 10pt; text-align: left; unicode-bidi: embed; direction: ltr;"><span b="" style="line-height: 115%; font-size: 12pt;"><font color="#000000" face="Calibri">In Islamic societies and among the Shiites in particular, in accordance with the necessity of respecting the divine rituals, mourning for the prophet and his esteemed family as an instance of divine rituals, is considered to be admired and appreciated. However, the mourning rituals, like many other sorts of social and religious issues, are the subject of the variety of interpretations and instances as some of mourners, venture into weird behaviors such as wounding themselves with cutlass, blade, and lock, walking on fire and hot coals, slithering on glass-dust and etc., and believe in the legitimacy of these behaviors. On the other hand, a group in the criminal justice system advocates the necessity of legal action against these sorts of behaviors.
