fa جایگاه اصل رسیدگی در مدت معقول در فرایند کیفری حقوق کیفری و جرم شناسی Criminal Law تحقیقات بنیادی یا نظری Research <div style="text-align: justify;"><span style="font-style:normal;"><span style="color:black;"><span style="font-family:b compset;"><span style="font-size:10.0pt;">رعایت مهلت معقول در سرتاسر فرایند رسیدگی کیفری که یکی از بنیادی‌ترین حقوق دفاعی متهمان است بر ضرورت تسریع معقول در فرایند دادرسی در معیت دقت حداکثری تأکید می‌کند که لازمه تحقق دادرسی عادلانه و غایت مطلوب محاکمات کیفری است. اجرای عدالت در مدت معقول از اصول اساسی دادرسی کیفری محسوب می‌شود. مفهوم معقول بودن مهلت دادرسی آن است که با صرف مهلتی متعارف بتوان به پرونده رسیدگی و از این طریق عدالت را برقرار کرد. تعیین اینکه چه </span></span></span></span><span style="font-style:normal;"><span style="color:black;"><span style="font-family:b compset;"><span style="font-size:10.0pt;">مهلتی</span></span></span></span><span style="font-style:normal;"><span style="color:black;"><span style="font-family:b compset;"><span style="font-size:10.0pt;"> متعارف و معقول است امر آسانی نیست. در مقاله حاضر سه معیار نوعی (عینی)، ذهنی (شخصی) و مختلط (بینابین) به‌‌ عنوان محکی برای تشخیص معقول بودن دوره دادرسی تجزیه و تحلیل شده‌اند. در معیار عینی تأکید بر تعیین مهلت دادرسی توسط مقنن است. در معیار ذهنی اوضاع و احوال هر پرونده است که مهلت معقول متناسب با آن پرونده را تعیین می‌‌کند و می‌‌تواند از پرونده‌‌ای به پرونده دیگر متفاوت باشد. سرانجام معیار مختلط از هر دو عامل فوق بهره می‌‌گیرد. در نهایت، پس از معرفی جلوه‌های عدم رعایت مدت معقول، ضمانت اجراهای عدم رعایت رسیدگی در مدت معقول بررسی می‌شود.</span></span></span></span></div> <div style="text-align: justify;">Observing a reasonable deadline throughout the criminal investigation process, as one of the most fundamental defensive rights of the accused, emphasizes the importance of reasonable expediting in the process of proceedings in a high degree of accuracy, which considers necessary for the fair trial and the desired outcome of criminal proceedings. Delivering justice within a reasonable time is one of the basic principles of criminal procedure. The concept of a reasonable period of due process is that through a reasonable period, it is possible to deal with the case and establish justice in this way; but it is not easy to determine howdeadline is normal and reasonable. In the present article, three criteria are analyzed as criteria for determining the reasonableness of the trial period: typical (objective), subjective (personal) and mixed (intermediate). The objective criterion emphasizes the determination of the deadline for prosecution by the legislature. The subjective criterion is the circumstances of each case, which determines a reasonable period appropriate to that case, and can vary from case to case. Finally, the mixed criterion utilizes both of the above factors.
