fa نقش اصول حقوقی در تفسیر قضایی قوانین حقوق خصوصی Pivate Law تحلیلی و انتقادی Critical & Analisis <div style="text-align: justify;"><span style="font-family:IRLotus;"><span style="font-size:13.0pt;">طبق اصل 166 قانون اساسی و مادۀ 3 قانون آیین دادرسی مدنی قضات موظفند که در صورت ابهام یا فقدان قانون به استناد اصول حقوقی حکم دعاوی را صادر نمایند. در این قوانین اولاً مفهوم اصول حقوقی در رابطه با قانون، روح قانون، فتاوی و قواعد فقهی مشخص نمی‌باشد. ثانیاً هیچ معیاری در اختیار قاضی نیست تا بتواند یک اصل حقوقی را از اصل غیرحقوقی تشخیص بدهد. اصول حقوقی برخلاف قانون و منابع معتبر اسلامی و فتاوی به‌صورت مکتوب نیستنند، به همین دلیل اجرای آن‌ها پیچیده و دشوار است. هدف اصلی این تحقیق، شناسایی اصول حقوقی به‌عنوان یک معیار و اصلی راهنما در تفسیر قوانین می‌باشد. اصول حقوقی نماینده وبازگوکنندۀ ارزش‌های موجود در یک جامعه هستند که قوانین بر اساس آن‌ها شکل می‌گیرند. بنابراین اصول حقوقی، معیاری درون‌قانونی و اصلی راهنما برای فهمیدن قانون می‌باشند؛ به این معنا که اصول حقوقی در صورت ابهام قانون، معیاری برای تفسیر قانون و در صورت فقدان قانون مبنا و مستندی برای احکام دادگاه‌ها می‌باشند. قاضی باید آن اصل حقوقی را اجرا کند که باعث انسجام قوانین و بهترین توجیه‌کننده برای آن‌ها باشد. تفسیر بر پایۀ اصول حقوقی باعث شکل‌گیری رویۀ واحد در محاکم می‌شود. </span></span></div> <span dir="LTR">According to articles 3 of laws of civil procedure, judges are responsible for issuing verdicts according to legal principles when there is ambiguity or lack of law. In these laws at first, the concept of legal principles is not distinctive on the relationship with laws, the spirit of law, judicial decrees and jurisprudential rules. Second, there is not any standard for judges to distinguish legal principle from non-legal principle. Legal principles in spite of law and Islamic reliable sources and judicial decrees are not collected into a book; therefore, their performances are complicated and difficult. The main goal of this investigation is the recognition of legal principles as the&nbsp;&nbsp; better standard for the interpretation of laws. Legal principles are representative of the community values that laws constitute according to it. So, legal principles are the best standard for comprehending law in this sense when the law is ambiguous, the legal principles are standards for interpretation of law and on the lack of law as the base for issuing verdicts on the courts. The judge must perform those legal principles that are as the best vindicator.
