fa عملیات صلح و رضایت اعطایی دولت در مداخله نظامی حقوق بین الملل International Law پژوهش كاربردي Applicable Research <div style="text-align: justify;"><span style="font-size:10pt"><span style="direction:rtl"><span style="unicode-bidi:embed"><span cambria="" style="font-family:"><span lang="FA" style="font-size:13.0pt"><span style="font-family:IRLotus"><span style="color:black">حفظ صلح و امنیت بین‌المللی مطابق منشور ازجمله وظایف اولیه شورای امنیت است، چنان‌که حتی می‌توان ادعا کرد، هسته بنیادین تشکیل ملل متحد بر حفظ صلح و امنیت بین‌المللی استوار گشته است. شورای امنیت در این زمینه اقدام به اجرای عملیات حفظ صلح نمود که با پیشرفت حقوق بین‌الملل شاهد نسل‌های بعدی چنین عملیاتی بودیم. نگارنده با فرض بر اثبات اعتبار رضایت دولت در اعطای آن جهت مداخله نظامی خارجی، ارتباط عملیات صلح و موضوع مداخله نظامی خارجی را به روش کتابخانه‌ای و شیوه تحلیلی، توصیفی موردنظر قرار داده و تلاش شده است تا از این گذار مشخص شود که آیا می‌توان عملیات صلح را در زمره و شمول حق حاکمیتی دولت‌ها، در اعطای رضایت نسبت به انجام مداخله نظامی در قلمرو دولت مذکور قرار داد یا خیر؟ بررسی نسل‌های مختلف عملیات صلح حکایت از این دارد که تجمیع دو معیار رضایت و اقدام نظامی در هیچ‌یک از مفاهیم حفظ صلح، ایجاد صلح و تحکیم صلح صورت نپذیرفته؛ از‌این‌رو تلقی عملیات صلح به‌عنوان زیرمجموعه مبحث دعوت به مداخله نظامی خارجی، میسر نیست</span></span></span><span lang="FA" style="font-size:13.0pt"><span style="font-family:IRLotus">. </span></span></span></span></span></span><br> &nbsp;</div> <div style="text-align: justify;"><span style="font-size:10pt"><span style="text-justify:inter-ideograph"><span style="unicode-bidi:embed"><span cambria="" style="font-family:"><span garamond="" style="font-family:">Maintaining international peace and security in accordance with the Charter is among the primary duties of the Security Council as it can even be claimed, the cornerstone of the formation of the United Nations is based on the maintenance of international peace and security. In this regard, the Security Council has been pursuing peace-keeping operations that, as international law advances, saw the next generation of such an operation.&nbsp; The author, with assuming the validity of the state&#39;s satisfaction in granting it to foreign military intervention, considers the relationship between peace operations and the issue of foreign military intervention in an analytical manner and attempts have been made to determine from this transition whether peace operations could be included in the sovereignty of states in order to give consent to military intervention in the territory of the said state.
