fa موانع داخلی الحاق ایران به کنوانسیون بیع بین المللی کالا حقوق خصوصی Pivate Law تحقیقات بنیادی یا نظری Research <div style="text-align: justify;"><span style="letter-spacing:-.1pt;font-style:normal;"><span style="color:black;"><span style="font-family:b compset;"><span style="font-size:10.0pt;">کنوانسیون بیع بین‌المللی کالا درصدد یکسان‌سازی حقوق داخلی کشورهایی که به این کنوانسیون ملحق می‌شوند، نیست. با این حال، توجه به این نکته که مطابق ماده 9 قانون مدنی مقررات عهودی که طبق قانون اساسی بین دولت ایران و سایر دول منعقد شده باشد در حکم قانون است و لزوم انطباق قوانین با احکام اسلام در اصل چهارم قانون اساسی، امکان‌سنجی الحاق ایران به این کنوانسیون ضروری است. کنوانسیون بیع بین‌المللی کالا مصوب 1980 (وین) برآیند تلاش برای یکنواخت‌سازی و همگن نمودن حقوق حاکم بر بیع بین‌المللی است که الحاق ایران به این کنوانسیون می‌تواند موجبات توسعه بازرگانی خارجی ایران و رونق اقتصادی را به دنبال داشته باشد. الحاق ایران به کنوانسیون مذکور با موانع داخلی و خارجی روبه‌رو است؛ موانع داخلی مثل محدودیت‌های موجود در قانون اساسی، نبودن برنامه‌های جامع و سیاست‌های کلی و مغایرتِ برخی از مقررات کنوانسیون با حقوق داخلی و موانع بین‌المللی نظیر مخالفت قدرت‌های جهانی از طریق اعمال تحریم‌های اقتصادی و ضعف دیپلماسی اقتصادی ایران. هیچ‌یک از موانع مذکور چالشی جدی در مسیر پیوستن ایران به کنوانسیون بیع بین‌المللی ایجاد نمی‌کند و آنچه تلاش گسترده حقوقدانان ایرانی در سال‌های اخیر در جهت تقریب مقررات کنوانسیون با حقوق داخلی را عقیم گذاشته، نبود عزم و اراده لازم در میان متولیان امر است.</span></span></span></span></div> <div style="text-align: justify;">Although the purpose of International Convention on the International sale of goods is not to unify the law of state parties, according to Article 9 of the Iranian Civil Code, &ldquo;the Provisions of the treaties which has been concluded between the Iranian state and other states according to the Constitution are as valid as the Statute&rdquo;. On the other hand according to the Article 4 of the Constitution all of the codes must be <s>compare</s> in conformity with Islamic law. The International Convention on the International Sale of Goods (Vienna, 1980), seeks to consolidate and harmonize laws governing international sale which Iran&#39;s accession to it could lead to the promotion of Iran&#39;s foreign trade and economic prosperity. Iran&#39;s accession to the said Convention is faced with internal and international restrictions. Some of internal restrictions comprise constitutional restrictions and the absence of comprehensive plans and general policies, as well as the violation of some of the provisions of the Convention by domestic law, and some of international restrictions include the opposition of the world&rsquo;s Superpowers through economic sanctions as well as the weakness of Iran&#39;s economic diplomacy. None of these issues poses a serious challenge to Iran&#39;s accession to the convention and what has been done in spite of the extensive efforts of Iranian lawyers in recent years to approximate the provisions of the Convention with domestic law, is the lack of determination among the practitioners.</div> کنوانسیون بیع بین‌المللی, فسخ, نقض اساسی, خسارت تأخیر, تجزیه‌پذیری قرارداد, عدم النفع.
