fa ضرورت اخطار قبلی در تصمیم‌گیری‌های اداری با نگاهی به حقوق اداری فرانسه The Necessity of Prior Notice in Administrative Decisions by looking at French law حقوق عمومی General Law تحلیلی و انتقادی Critical & Analisis <div style="text-align: justify;"><span style="color:black;"><span style="font-family:b compset;">حق بر شنیده شدن دفاعیات، بهعنوان یکی از عناصر اساسی حقوق دفاعی، یکی از حقهای بسیار مهمی است که بهخصوص در دهههای اخیر در حقوق اداری نیز مورد توجه بسیار قرار گرفته و نقش ویژهای را در حمایت از حقوق و منافع شهروندان- متأثر از تصمیمات مقامات اداری ایفا مینماید. با وجودبرخی تفاوتها، این اصل و نیز ضرورت رعایت آن در نظامهای حقوقی ایران و فرانسه پذیرفته شده است. یکی از لوازم حق بر شنیده شدن دفاعیات، یعنی اخطار قبلی به فرد در خصوص رسیدگی اداری قریب‌الوقوعی می&rlm;باشد که ممکن است حقوق و منافع وی را تهدید نماید. در این مقاله تلاش شده است تا ضمن بیان جایگاه اخطار قبلی در تصمیمگیریهای اداری و ضرورت توجه به ابعاد آن، با نگاهی به حقوق فرانسه، تحلیلی نیز در مورد چگونگی اعمال این مسأله در حقوق اداری ایران ارائه گردد.</span></span></div> <div style="text-align: justify;">The right to be heard as one of the main elements of the principle of right of defense,is one of the important rights that, particularly in recent decades, has been taken into consideration in administrative law, and plays a special role in protecting the rights and interests of citizens affected by administrative decisions. It should be noted that this principle and the necessity of its observance, despite certain differences, has been accepted in Iranian and French legal systems. One of the issues related to the right to be heard is prior notice to an interested person about an imminent decision-making process that may threaten his rights and interests.
