fa مبنای تعهد طبیعی و روش‌های ورود آن به دنیای تعهدات حقوقی کامل The Basis of Natural Obligation and the Methods of its Entry into the World of Full Legal Obligations حقوق خصوصی Pivate Law تحقیقات بنیادی یا نظری Research با توجه به فقر منابع نوشتاری در شرح کامل ماده 266 قانون مدنی، نهاد تعهد طبیعی در ادبیات حقوقی ایران جایگاه خود را باز ننموده و همین امر، زمینه‌ساز عدم شکل‌گیری رویه<span dir="LTR"></span> قضایی در این خصوص شده است.  با توجه به تجزیه ذات تعهد حقوقی کامل به دو عنصر «دین» و «الزام به تأدیه»، مبنای تعهد طبیعی را «تعهد حقوقی ناقص از نوع تغییر ماهیت داده» می‌دانیم که در آن تعهد طبیعی، تعهدی است که سابقاً بر پایه یک رابطه حقوقی کامل شکل گرفته و قانونگذار بنا به مصالحی، عنصر «الزام به تأدیه» را از آن سلب نموده است. به عبارتی، علاوه بر آن‌که فقدان عنصر «الزام به تأدیه »را در تعریف ناقص بودن دارد، نمایانگر رابطه حقوقی سابق میان طلبکار و بدهکار تعهد طبیعی بوده و تأیید افکار جامعه را نیز در بطن خود داراست. انواع روش&lrm;های ورود یک تعهد طبیعی به دنیای تعهدات حقوقی کامل، از جمله طُرقِ قراردادی همچون التزام به پرداخت دین طبیعی ضمن قرارداد خارجی، تبدیل تعهد طبیعی، تسلیم رهن و دادن ضامن برای دین طبیعی؛ طرق ایقاعی همچون اراده متعهد در اجرای تعهد طبیعی و التزام به پرداخت دین طبیعی با استمرار به تأدیه و طرق قهری همچون تهاتر و مالکیت ما فی‌الذمه را بیان نموده‌ایم. Natural Obligation is an Obligation which its Implementation has Conscious Aspect and ignores the Legal Executive Guarantee. Regarding to the Lack of written Resources in the full Description of the Article 266 in Civil Law, The Institution of Natural Obligation has not found its place in the Iranian Legal Literature and this is the reason for the Lack of Judicial Procedure in This Context. In this Article, with Respect to the Decomposition of the Essence of the full Legal Obligation to the two Elements of "Debt" and <span dir="RTL">"</span>Coercion to Payment", We Consider the Basis of Natural Obligation as "Incomplete Legal Obligation of the denatured Type" in which, the Natural Obligation is the Obligation that Formerly was formed based on a Complete Legal Relationship and then, according to the expediency, the Legislator has deprived it of the Element "Coercion to Payment".
