fa قرارداد تشکیل حساب جاری بانکی در حقوق ایران و تطبیقی حقوق خصوصی Pivate Law پژوهش كاربردي Applicable Research چکیده:<br> با تشکیل قرارداد حساب جاری بانکی ، حسابی تحت عنوان و به نام متقاضی نزد بانک افتتاح می<span dir="LTR">‌</span>شود. مطابق آنچه که از مفاد این قرار داد و قصد طرفین قرارداد دانسته می<span dir="LTR">‌</span>شود، بانک در مقابل صاحب حساب متعهد می<span dir="LTR">‌</span>گردد کلیه وجوهی را که صاحب حساب یا اشخاص ثالث قصد واریز به این حساب دارند را بپذیرد، و متقابلاً صاحب حساب حق واریز وجوه به این حساب را خواهد داشت<span dir="LTR">. </span>عین وجوه واریزی به این حساب به تملک بانک در آمده و بانک معادل وجوه دریافتی مدیون صاحب حساب می<span dir="LTR">‌</span>گردد، لذا صاحب حساب حق خواهد داشت در هر زمان با صدور چک&nbsp; عین وجوه واریزی خویش را از بانک مطالبه، نماید و بانک نیز متعهد می<span dir="LTR">‌</span>گردد و به محض مطالبه، دین خویش را به صاحب حساب یا هر شخص دیگر دارنده<span dir="LTR">‌ </span>چک، بپردازد. از میان تعهدات فوق تنها تعهد بانک به پذیرش وجوه واریزی تعهدی منجز بوده و به صرف انعقاد قرارداد بوجود آمده و قابل مطالبه می<span dir="LTR">‌</span>باشد و سایر تعهدات مندرج در این قرارداد معلق به &nbsp;واریز وجوه به حساب می<span dir="LTR">‌</span>باشند و به صرف انعقاد قرارداد بوجود نیامده و قابل مطالبه نمی<span dir="LTR">‌</span>باشند، در این مقاله به بررسی قرارداد تشکیل حساب جاری بانکی و نیز مقررات و شرایط عمومی و اختصاصی این قرارداد پرداخته می&shy;شود.<br> &nbsp; <br> &nbsp;Abstract:<br> <strong><em>By creating a bank account agreement, an account is opened under the name of the applicant in the name of the bank.
