fa مطالعه تطبیقی اختیار دادستان در دیوان کیفری بین المللی و نظام کیفری ایران از منظر دادرسی منصفانه حقوق کیفری و جرم شناسی Criminal Law پژوهش كاربردي Applicable Research <br> &nbsp;&nbsp; نهاد دادستان در فرایند تعقیب کیفری، با تامین حقوق و الزامات برابر در تدارک دفاع برای متهم، نقش بسزایی در تحقق دادرسی منصفانه در نظام‌های داخلی و بین‌المللی ایفاء می‌کند. تحقیق حاضر درصدد بررسی الزامات دادرسی عادلانه در قلمرو اختیار دادستان در مرحله تحقیقات مقدماتی با تاکید بر فرایند آغاز تعقیب در دیوان کیفری بین‌المللی در مقایسه با حقوق ایران است. تعقیب کیفری در اساسنامه دیوان از اهمیت و سازوکار خاصی برخوردار است. اختیار دادستان ترکیبی مقتبس از نظام‌های حقوقی کامن لا و نوشته است و متضمن رعایت بسیاری از الزامات دادرسی عادلانه است. به لحاظ حذف نهاد بازپرسی، انجام امر تحقیق در کنار وظیقه تعقیب به عهده دادستان است، لیکن تمام وظایف دادستان تحت نظارت قضایی انجام می‌شود. درحقوق ایران تجمیع اختیارات متعدد در مقام دادستان، فقدان کنترل قضایی بر اقدامات وی، قیمومت دادستان نسبت به بازپرس، فقدان رسیدگی ترافعی در تحقیقات مقدماتی حکایت از عدول مقنن از بسیاری از اصول دادرسی منصفانه همانند تفکیک مقام تعقیب از مقام تحقیق، برابری سلاحها، بی طرفی و استقلال قضایی دارد. بهره‌گیری از نظام حاکم بر دیوان که درصدد ایجاد هماهنگی بین نظام‌های حقوقی ملی در امر تعقیب کیفری بوده است، می ‌تواند نفش به‌سزایی در تثبیت اصول دادرسی عادلانه ایفاء کند.<span dir="LTR"></span><br> &nbsp;&nbsp; &nbsp;<br> <br> <strong><span dir="LTR">abstract</span></strong><br> prosecutor&#39;s office with equal rights in the case The defendant plays an important role in a fair hearing in domestic and international systems.
