fa پلیس ویژه ابلاغ و اجرای احکام کیفری حقوق کیفری و جرم شناسی Criminal Law پژوهش كاربردي Applicable Research <strong>چکیده - پلیس اجرا</strong> <div style="text-align: justify;"><span dir="RTL">تشکیل پلیس ویژه ا<a name="_GoBack"></a>جرای احکام کیفری و ابلاغ مستقر در محل دادسرا و تحت نظارت و تعلیمات دادستان، نوآوری دو دستورالعمل ساماندهی واحدهای اجرای احکام کیفری مصوب 1388 و 1391 رئیس قوه قضاییه است. ایجاد پلیس مذکور، با قانون اساسی مغایرتی ندارد و در قوانین عادی از جمله قانون آیین دادرسی کیفری مصوب 1392 و قانون مبارزه با قاچاق کالا و ارز مصوب 1392 به وظیفه اجرایی و تشکیل آن در واحدهای اجرای احکام کیفری و تعزیرات حکومتی اشاره شده است. هدف از تشکیل پلیس ویژه اجرای احکام و ابلاغ، تسریع در ابلاغ اوراق قضایی و اجرای سریع احکام است. در راستای تسریع در ابلاغ اوراق قضایی این پلیس وظیفه ابلاغ احضاریه، ابلاغ به کفیل و وثیقه &shy;گذار، ابلاغ برگ جلب و ابلاغ به محکوم&shy;له را به عهده دارد. در راستای تسریع در اجرای احکام، پلیس ویژه، وظیفه جلب محکوم&shy; علیه، اجرای دستورات مربوط به رفع تصرف از اراضی، اجرای مجازات&shy;های سالب حیات، اجرای مجازات&shy;های بدنی، نظارت بر حضور و فعالیت محکومان به تبعید یا اقامت اجباری و منع از اقامت در محل معین، استرداد، ضبط یا معدوم کردن اموال ناشی از جرم را به عهده دارد. </span></div> <div style="text-align: justify;">Establishment of The special police formation for enforcement of penal sentences and announcement at the court and under the supervision of prosecutor&rsquo;s training is the innovation derived from the two guidelines for organizing the execution units of the penal judgments adopted by the head of the judiciary in 2009 and 2012. There is no conflict between forming special police and the constitution, and its executive function and formation in the units of enforcement of penal sentences and government sanctions are regulated by customary law, such as 2013 Code of Criminal Procedure and 2013 Anti-Smuggling of Goods and Currency Act. The purpose of the special police formation is to quick announcement and the fast implementation of sentences. However, this issue has not been addressed in spite of sufficient regulations and the strong need for specialized enforcement units to enforce judicial orders and decisions. The purpose of the article is to outline the legal status and duties of the special police force in enforcing sentences and notifications and to draw the attention of the authorities to the establishment of this institution throughout the country.
