fa اثر بخشی آموزه‌های عدالت ترمیمی بر وضعیت بزه‌‌دیدگان در جوامع انتقالی حقوق بین الملل International Law پژوهش كاربردي Applicable Research <div style="text-align: justify;"><span style="font-size:10pt"><span style="direction:rtl"><span style="unicode-bidi:embed"><span cambria="" style="font-family:"><span lang="FA" style="font-size:13.0pt"><span style="font-family:IRLotus">جبران خسارت‌های بزه‌دیدگان یکی از آثار اعمال فرایند عدالت ترمیمی در برخورد با جرایم ارتکابی است. این آثار موجب اعاده توانمندی بزه‌دیده جهت احیاء شأن انسانی و کرامت از دست رفته آن می‌شود، همچنین جبران خسارت‌ها می‌توانند آثار تخریبی جرم را بر روح و جسم وی کاهش دهد. در جوامع در حال گذار، دولت انتقالی با آمار گسترده بزه‌دیدگانی روبروست که طی درگیری‌های متعدد با سوابق تاریخی طولانی، خسارت‌های زیادی را متحمل شده است. این قشر از جوامع انتقالی تحت تاثیر نقض‌های وسیع حقوق بشری و بشردوستانه دوران درگیری دچار خسارت‌های متعدد جسمی و روحی شده‌اند. دولت انتقالی در تکاپوی ارضای‌خاطر بزه‌دیدگان با به‌کارگیری سازو کارهای قضایی و غیرقضایی به‌دنبال اصلاح و بازسازی جامعه انتقالی از طریق آشتی ملی است. به‌نظر می‌رسد اجرای فرایند عدالت ترمیمی با سازوکارهای غیررسمی و غیرقضایی ازجمله به‌کارگیری کمیسیون تحقیق و آشتی یا سازوکار سنتی اجرای عدالت بتواند با حمایت‌های خاص نسبت به بزه‌دیدگان و جبران خسارت‌های مادی و معنوی آنان، پاسخ‌گوی انتظارات این قشر و انجام رسالت دولت انتقالی شود. از‌این‌رو در این مقاله سعی بر این است تا با بررسی آثار فرایند عدالت ترمیمی بر اصلاح اوضاع بزه‌دیدگان و جبران خسارت‌های آنان توأم با حفاظت و حمایت از این قشر، در مقابل خشونت‌های احتمالی آینده از طریق مشارکت آنان در فرایند عدالت، موجبات هم‌زیستی مسالمت‌آمیز در جامعه انتقالی را فراهم کند.</span></span></span></span></span></span></div> <p style="margin: 0cm 0cm 10pt; text-align: justify; line-height: normal; unicode-bidi: embed; direction: ltr;"><span style="font-size:10pt"><span style="text-justify:inter-ideograph"><span style="unicode-bidi:embed"><span garamond="" style="font-family:">Transitional Communities include a large number of citizens who have been victimized with widespread human rights violations caused by prolonged conflicts. Meanwhile, the transitional government seeks to respond to the injustices imposed on this group by using various judicial and non-judicial mechanisms to satisfy the victims.</span></span></span></span><br> <span style="font-size:10pt"><span style="text-justify:inter-ideograph"><span style="unicode-bidi:embed"><span garamond="" style="font-family:">Victims of transitional societies also look forward to the implementation of justice for inhumane violence during the conflict, to compensate for restoring the ability to continue life and lost dignity. Therefore, the application of the restorative justice process can meet the expectations of the victims and carry out the mission of the transitional government due to supporting victims and the process of compensation.
