fa فلسفه دلیل مندی تصمیم قضایی حقوق کیفری و جرم شناسی Criminal Law پژوهش كاربردي Applicable Research سرنوشت دادرسی در قالب تصمیم قضایی رقم می خورد. بدون دلیل نمی توان دادرسی کیفری را موجه و مشروع دانست. به صراحت قانون اساسی و عادی ایران هر تصمیم قضایی باید دلیل مند باشد. این که چرا و به چه علت مقام قضایی موظف است که تصمیم خود را مدلل نماید، می توان از لابلای مجموعه قوانین استخراج نمود. دلیل مندی تصمیم قضایی دارای مبانی عقلی، اخلاقی و روانشناختی است. عادلانه بودن و عقلانی بودن دادرسی در تصمیم قضایی آشکار می شود. در صورتی که مقام قضایی تصمیم خود را مدلل نماید، اعتماد و اطمینان به مقام قضایی ایجاد و افزایش خواهد یافت و از طرح مجدد دعاوی جلوگیری به عمل خواهد آمد. بدون دلیل آوری، تصمیم قضایی ناعادلانه خواهد بود و موجب سلب امنیت فردی و اجتماعی و اعتماد عمومی و سبب استبداد و خودرایی مقام قضایی خواهد شد و نقض مداوم تصمیمات او در مراجع عالی به دنبال خواهد داشت.<br> &nbsp; <strong>Abstract</strong><br> The fate of criminal proceedings is predestined under the framework of a juridical decision. Without any reason the criminal proceedings can be viewed as authorized and legitimate. Any juridical decision should be documented and well-founded and in other words should be justified. The center of gravity and concentration in the criminal proceedings is the exact juridical decisions and its foundations should be justified and should always follow a reason. Without bringing reason the juridical decision lacks legitimacy and it disrupts the criminal justice. The end and purpose of criminal proceedings should be a decision that has the legitimacy and acceptability which are earned legally and proving the justifiability of it is up to the juridical authority.Justifiability of a juridical decision guarantees the mutual rights in a case,the prevention of the arbitrary of juridical authorities, judicial security and preventing the abolition in judgments.
