fa ایدئولوژی قضایی حقوق عمومی General Law تحقیقات بنیادی یا نظری Research <div style="text-align: justify;"><span style="font-size:10pt"><span style="direction:rtl"><span style="unicode-bidi:embed"><span cambria="" style="font-family:"><span lang="FA" style="font-size:13.0pt"><span style="font-family:IRLotus">ایدئولوژی مفهومی است که در دهه‌های انقلاب فرانسه پا به عرصۀ وجود گذاشت و بعدها در ابعاد مختلف رشد و تکامل یافت. رشد و تکاملی که در معانی منفی و مثبت قابل‌توجه است. ورود ایدئولوژی به عرصۀ دولت و نفوذ در برساخت‌های اجتماعی اهمیت آن را دوچندان کرد. سطح قضاوت نیز از این نفوذ مصون نماند و در حداقل سطح آن مفهومی به‌نام &laquo;ایدئولوژی قضایی&raquo; را آفرید. این نوشتار ضمن تشریح مفهوم ایدئولوژی در معنای معرفت‌شناختی آن که جزئی لاینفک و حتی ضروری از ذهنیت قاضی است، معنای منفی ایدئولوژی به‌عنوان نگاهی سیاست‌زده و خارج از چارچوب به مسائل قضایی که با سازمان‌یافتگی، تعصب و جزمیت گره خورده است، را به تصویر می‌کشد. همراهی دائمی ایدئولوژی با افکار قاضی، ما را به سمت یک مسیر سوق خواهد داد تا در چارچوب حاکمیت قانون که هدفِ نهایی ایجاد دستگاه قضایی است، جولانگاه ایدئولوژی در آرای قضات را بکاویم.</span></span></span></span></span></span><br> &nbsp;</div> <div style="text-align: justify;"><span style="font-size:10pt"><span style="text-justify:inter-ideograph"><span style="unicode-bidi:embed"><span cambria="" style="font-family:"><span garamond="" style="font-family:">Ideology is a conception that existed in the early decades of the French Revolution, and was later developed in different dimensions. The&nbsp; development which is significant in both negative and positive meanings. Penetration of the ideology to the state arena and its influence in social fabrications doubled its importance. The level of judgment was not immune to this influence, and at the very least it has created a concept called &quot;judicial ideology&quot;. This paper while describing the conception of ideology in epistemological meaning, as an integral, and even essential, element of the judge&#39;s mentality, depicts the negative meaning of ideology as an politicized and out of the framework&nbsp; which is tied with the organization, fanaticism and decisiveness.
