fa نقش قوه قضاییه در حل و فصل اختلافات تجاری به روش‌های الکترونیکی غیرقضایی حقوق عمومی General Law پژوهش كاربردي Applicable Research &nbsp;&nbsp;با توجه به رشد سریع تجارت الکترونیک و افزایش چشمگیر دعاوی ناشی از آن طی سال‌های اخیر؛ شناخت فرصت‌ها و چالش‌های &laquo;حل و فصل اختلافات تجاری به روش‌های الکترونیکی غیرقضایی&raquo; برای دعاوی تجاری و بررسی شرایط مداخله ارکان ذیربط حکومت ‌در آن، امری غیرقابل اجتناب خواهد بود؛ به ویژه تبیین نقش قوه‌قضاییه در این رابطه؛ به عنوان یکی از مراجع اصلی و ارگانی که دارای تجارب ارزشمند و مشابه در زمینه دادرسی الکترونیکی می‌باشد. لذا، در مقاله پیش‌رو، پس از تبیین تاریخچه؛ فرصت‌ها و چالش‌های مهم موضوع فوق، در بخش‌های دوم تا چهارم به ترتیب، به نقش‌های حمایتی، مشارکتی و نظارتی قوه قضاییه در این زمینه پرداخته خواهد شد<span dir="LTR">.</span><br> <br> &nbsp;&nbsp;&nbsp;&nbsp;&nbsp; هرگونه دخالت قوه قضاییه در این فرآیند، باید به گونه‌ای طراحی و در سایه همکاری نزدیک با دستگاه‌های دولتی ذیربط و سازمان‌های مردم ‌نهاد غیردولتی به اجرا درآید که از بروز اقدامات موازی میان آنها و فعالیت به صورت جزیره‌ای و ناهماهنگ اجتناب شود و با عنایت به اختیارات وسیعی که قانونگذار به دادگاه‌ها برای شناسایی و اجرای آراء داوری آنلاین اعطاء نموده؛ ضمن تبیین شرایط شناسایی و اجرای آراء مزبور و تلاش برای ایجاد وحدت رویه؛ ظرفیت‌ها و کارکردهای خاص قوه قضاییه در این راستا نیز، شناسایی و توصیه گردد<span dir="LTR">.</span> Taking into account of rapid growth of international trade and the dramatic increase of the disputes arisen therefrom, it is indispensable to recognize the opportunities and challenges of &quot;Electronic Alternative Dispute Resolutions (EADR)&quot; for commercial disputes and to identify the conditions of interventions by the relevant governmental entities in the regulation and control of activities of online arbitration or mediation tribunals.<br> &nbsp;&nbsp;&nbsp;&nbsp; This Article, at first, describes the history, opportunities and challenges of &ldquo;EADR&rdquo; and prevailing obstacles hindering its development and then, in the following sections, we will endeavor to clarify the roles and function of Judicial Power in its support, contribution and supervision for the development of &ldquo;EADR&rdquo;.<br> As a conclusion, any intervention by the Judiciary Power in these activities must be planed and executed in the close cooperation with other relevant governmental and non-governmental entities so that no parallel action occurs in these regards and any inconsistent or insular official program is avoided. In addition, the prerequisites for the recognition and enforcement of online dispute resolutions should be identified in more details.
