fa توسعه حقوق بشر در پیش نویس مواد کمیسیون حقوق بین الملل درباره اخراج بیگانگان حقوق بین الملل International Law پژوهش كاربردي Applicable Research رفتار با بیگانگان در حقوق بین الملل از قدمت طولانی برخوردار است و همواره موضوعی بحث برانگیز بوده است. چالش اصلی در این خصوص، برقراری تعادل میان حفظ حاکمیت دولتها از یک سو و حمایت از حقوق بیگانگان از سویی دیگر است. اخراج بیگانگان یکی از شاخه های اصلی مبحث کلی نحوه رفتار با بیگانگان در حقوق بین الملل می باشدکه تحت تاثیر انسان محور شدن حقوق بین الملل و همراه با توسعه تدریجی حقوق بشر، مقررات حاکم بر این حوزه به نحو چشمگیری متحول شده است. کمیسیون حقوق بین الملل به تازگی، پیش نویس موادی را درخصوص موضوع &laquo;اخراج بیگانگان&raquo; همراه با شرح و تفسیر مواد آن به تصویب رسانده است. در شرح ماده 3 پیش نویس اشاره شده است که مواد پیش نویس شامل تدوین و توسعه تدریجی حقوق بین الملل است. مقاله پیش رو به بررسی برخی مواد پیش نویس، از منظر توسعه حقوق بشر پرداخته و مواد پیش نویس را به صورت تطبیقی با قواعد موجود حقوق بین الملل مورد ارزیابی قرار می دهد.<br> &nbsp; <strong>Development of International Human Rights Law in the ILC Draft Articles on &ldquo;Expulsion of Aliens&rdquo;</strong><br> <strong>Abstract</strong><br> The treatment of aliens has a long history under international law and has always been a controversial Issue. In this context the main issue is to compromise between the sovereignty of states and the protection of human rights of aliens. The expulsion of aliens is one of the most important subdivisions of international law on treatment of aliens. Since the nineteenth century, affected by the process and dialogue of humanization of international law and with Progressive development of Human Rights Law, the laws regulating this domain have been impressively evolved.<br> Recently international law commission (ILC) has adopted the draft articles on the &ldquo;expulsion of aliens&rdquo; with commentaries. The commentary on draft article 3 point out that the draft articles involve both codification of existing international law and progressive development of international law, twin aspects of the ILC&rsquo;s mandate.
