fa مطالعه تطبیقی و تحلیلی مفهوم و جایگاه طرف ثالث قرارداد حقوق خصوصی Pivate Law تحلیلی و انتقادی Critical & Analisis در قراردادی که طرفین برای خود منعقد می‌کنند، ممکن است حق یا تعهدی نیز برای ثالث ایجاد نمایند. در مورد اینکه نمی‌توان برای ثالث به طور مستقیم ایجاد تعهد کرد، تقریباً اختلاف نظر وجود ندارد. آنچه که مورد بحث است، امکان ایجاد حق مستقیم برای ثالث به موجب قرارداد، خواه با رضایت قبلی یا بعدی یا عدم رضایت اوست. در این مقاله به بررسی پیشینه، مفهوم، ماهیت&nbsp; و آثار حقوقی تعهد به سود ثالث پرداخته می‌شود. این بررسی بیشتر مبتنی بر مطالعه در حقوق کامن‌لا و تا حدودی رومی‌ـ ژرمنی است که با تأکید بر نظریات حقوقدانان و رویه قضایی صورت می‌گیرد.<br> <strong>واژگان کلیدی: </strong>حق، تعهد به سود ثالث، آرای محاکم، شخص ثالث، دکترین عوض و اصل نسبی بودن قرارداد. Stipulation for the benefit of a third party<br> In a contract the parties may stipulate a right or an obligation for the benefit of a third part. There is almost no disagreement as to the impossibility of stipulation directly a right for the benefit of a third party, with or without his or her prior or later consent or disagreement.&nbsp;<br> In this article, the background, concept, nature and the legal effects of such stipulation is studied.
