fa تحلیل مکانیسم و چالشهای ثبت نرم افزارها و پروتکل های حوزۀ اینترنت اشیا حقوق خصوصی Pivate Law پژوهش كاربردي Applicable Research <div style="text-align: justify;"><span style="font-family:IRLotus;"><span style="font-size:13.0pt;">اینترنت اشیا فناوری تعامل و ارتباط میان ابزارها می‌باشد که در آن با تعبیۀ پروتکل‌‌‌ها و نرم‌افزارهای طراحی‌شده بر پردازندۀ یک سخت‌افزار، امکان ارتباط این ابزارها با یکدیگر، عامل انسانی و انجام وظایف تعیین شده فراهم می‌گردد. برای آنکه نرم‌افزار یا پروتکلی قابلیت ثبت داشته باشد، باید از کاربرد عملی و خصوصیت نوآورانه نسبت به گونه‌‌‌‌های هم نوع خود برخوردار گردد. به جهت ماهیت و کیفیت طراحی پروتکل‌‌‌ها و نرم‌افزارهای الکترونیک، طراحی موارد مذکور مخصوص به ابزاری هوشمند، هرچند نسبت به گونه‌‌‌‌های مشابه دارای هم‌پوشانی عملکردی باشد، به منزلۀ نقض حق معنوی دارندۀ اثر اولیه تلقی</span></span><span dir="LTR">‌‌</span><span style="font-family:IRLotus;"><span style="font-size:13.0pt;"> نمی‌گردد. سازوکار ثبت اقلام بیان شده در نظام حقوقی آمریکا تحت دو مکانیسم اینترپارتس (درخواست جهت ثبت اقلام طراحی شده در صورت وجود شرایط قانونی) و پست گرنت (کیفیت رسیدگی به درخواست صورت گرفته و اعتراضات مدعیان نسبت به اقلام طراحی شده) صورت</span></span><span dir="LTR">‌‌</span><span style="font-family:IRLotus;"><span style="font-size:13.0pt;"> می‌گیرد. </span></span></div> IoT is a technology of interaction and communication between tools, whereby the embedded protocols and software on a hardware processor enable the communication of these tools with one another, the human agent and the assigned tasks. For software or protocol to be capable of being registered, it must have practical application and innovative properties relative to its species. Because of the nature and quality of the design of protocols and electronic software, the design of such cases for a smart instrument, although overlapping with similar variants, shall not be regarded as infringing the copyright of the original work.
