fa بررسی تطبیقی ضمانت اجراهای نقض حقوق دفاعی متهم توسط ضابطان درحقوق ایران وامریکا حقوق کیفری و جرم شناسی Criminal Law تحلیلی و انتقادی Critical & Analisis از اقدامات سالب آزادی که در تحقیقات <strong>ضابطان</strong> بر متهمین اعمال می شود، تحت نظر قراردادن آنان است. به طور کلی در هر دو نظام کیفری ایران و آمریکا حقوقی برای &nbsp;متهم در نظرگرفته شده است. اما درحقوق آمریکا، برخلاف حقوق ایران که بر اساس ماده&nbsp; 48 <strong>قانون آیین دادرسی کیفری </strong>تعیین وکیل تنها در بعضی جرایم و مدت حضور نیز صرفاً به یک ساعت محدود شده است، حق داشتن وکیل بدون تفکیک جرایم لحاظ شده و متهم می تواند تا زمان حضور وکیل سکوت کند و نیز به مدت زمان خاصی محدود نمی باشد. قانونگذار ایران در مورد اصل تفهیم اتهام، ضمانت اجرای این حق، دلایلی که با نقض آن تحصیل می شوند، حق سکوت و اینکه متهم در هر زمان می تواند به این حق استناد کند و به بازجویی خاتمه دهد، ساکت است. لذا در زمینه اقدامات ناقض حق رعایت حریم خصوصی بهتر است قانونگذار اقدامات مذکور را به جرایم مهم &nbsp;محدود می ساخت. در حقوق آمریکا علاوه بر الزام ضابطان به تفهیم اتهام واعلام حق سکوت و داشتن وکیل، ضمانت اجراهای مدنی،کیفری، انتظامی و بطلان یا رد دلایلی که از طریق نقض این حقوق به دست آمده، پیش بینی شده است.<br> &nbsp; One of measures taken in the investigations by the officers, is the monitoring of the accused.
