fa نحوه برخورد با باغیان در فقه امامیه و عامه (تطبیق با قانون مجازات اسلامی) حقوق کیفری و جرم شناسی Criminal Law تحلیلی و انتقادی Critical & Analisis منشأ جرم&shy;انگاری بغی، مقررات اسلامی و شرع مقدس است که در قانون مجازات اسلامی مصوب 1392 از محاربه جدا و به عنوان مستقل جرم&shy;انگاری شد. با توجه به اینکه بغی، یک جرم حدی و مستوجب اعدام است، انتظار این است نحوه مقابله و مجازات باغیان، با حساسیت زیاد و با در نظر گرفتن مبانی فقهی، تعیین و تشریح شود. بر این مبنا، موضوع این مقاله نحوه برخورد و مجازات باغیان در مقررات اسلامی و تطبیق با موضع قانون مجازات اسلامی مصوب 1392 است تا مشخص شود که میزان مسئولیت کیفری باغیان در قانون تا چه میزان با آموزه&shy;های فقهی مطابق دارد. این تحقیق با روش توصیفی- تحلیلی، آیات قرآن و احادیث و منابع متعبر اسلامی را بررسی نموده و در پایان مشخص شد علیرغم اینکه قانونگذار سعی نموده در جرم انگاری و مجازات باغیان به آموزه&shy;های فقهی پایبند باشد، <span dir="RTL">اما در کیفرگذاری اشتباه کرده است و</span>&nbsp;<span dir="RTL">برای آن مجازات حد مقرر نموده است، در حالی که اکثر فقها، به حدی بودن جرم مذکور نظر نداده &shy;اند</span><br> &nbsp; <span style="font-size:10pt"><span style="text-justify:inter-ideograph"><span style="unicode-bidi:embed"><span cambria="" style="font-family:"><span garamond="" style="font-family:">Islamic regulations are the source of rebellious criminality that in Islamic Penal Code 1392 Separated from moharebeh and became an independent criminal.
