fa نقش ساماندهی رفاه اقتصادی- شغلی گروه های در آستانه خطر در پیشگیری از وقوع قاچاق کالا و ارز حقوق کیفری و جرم شناسی Criminal Law پژوهش كاربردي Applicable Research <div style="text-align: justify;">&nbsp;<span style="font-family:IRLotus;"><span style="font-size:13.0pt;">&nbsp;امور رفاهی گروه‌های در آستانۀ خطر من</span></span><span dir="LTR">‌</span><span style="font-family:IRLotus;"><span style="font-size:13.0pt;">جمله کارکنان متکفل مبارزه با قاچاق کالا و ارز به‌عنوان یکی از راهکارهای پیشگیری اجتماعی می‌تواند نقش مؤثری در پیشگیری از وقوع جرائم مرتبط با قاچاق ایفا نماید. با توجه به ماهیت اقتصادی بزه قاچاق کالا و ارز، میزان ارائۀ خدمات عمومی و رفاهی توسط دولت و حاکمیت این دسته از کارکنان می‌تواند از عوامل مهم پیشگیری از ارتکاب بزه، محسوب شود. هنگامی که شهروندان در بهره‌مندی از شرایط اقتصادی از فرصتی برابر برخوردار نباشند، در پس بخشنامه‌ها و قوانین و مقررات اداری، محیط‌های آلودۀ مناسبی برای رانت‌خواری، رشوه‌خواری و فساد مالی پدید می‌آید؛ در چنین شرایطی، هرگونه مبارزه با مفسدان مبارزه با معلول خواهد بود. تغییر اوضاع نابسامان اجتماعی، فرهنگی و اقتصادی و نیز مبارزه با عوامل روانی ارتکاب جرم، هستۀ اصلی پیشگیری اجتماعی است. این مسئله در مقررات مختلف و حتی قانون اساسی مورد تأکید قرار گرفته است. مقالۀ حاضر درصدد است به بررسی راهکارهای &laquo;ساماندهی رفاه اقتصادی&raquo;، به‌عنوان یکی از ابزارهای پیشگیری اجتماعی از وقوع بزه قاچاق کالا و ارز پرداخته و جایگاه آن را در سیاست جنایی تقنینی کشور در پرتو اسناد بالادستی از جمله قانون اساسی و سیاست</span></span><span dir="LTR">‌</span><span style="font-family:IRLotus;"><span style="font-size:13.0pt;">های کلی نظام جمهوری اسلامی ایران و همچنین قانون مبارزه با قاچاق کالا و ارز مصوب 1392، تحلیل نماید. </span></span></div> The welfare of groups at risk, including staff engaged in the fight against trafficking in goods and currencies, as one of the social prevention strategies can play an effective role in preventing the occurrence of trafficking-related offenses. Given the economic nature of the crime of trafficking in commodities and currencies, the amount of public and welfare services provided by the government and the sovereignty of these employees can be important factors in preventing crime<span dir="RTL">.</span><br> &nbsp;&nbsp;&nbsp;&nbsp;When citizens are not afforded an equal opportunity to benefit from economic conditions, behind the circuits and administrative laws and regulations, favorable environments for rent-seeking, bribery, and corruption emerge; Fighting will be handicapped. Changing social, cultural and economic conditions, as well as combating the psychological factors of crime, are at the core of social prevention.
