fa حق تصویر در مکان عمومی Image right in public places حقوق خصوصی Pivate Law تحقیقات بنیادی یا نظری Research حق تصویر از جمله حقوق وابسته به شخصیت انسان است که بر اساس آن، امکان تصویربرداری و استفاده از تصویر در حوزه اختیارات شخص قرار میگیرد. لذا تصویربرداری و انتشار آن مستلزم کسب رضایت شخص موضوع تصویر است. با این حال، این حق مطلق نیست و در مکان عمومی محدود میشود. سایر نظامهای حقوقی، ضمن «حفظ حریم خصوصی» و «پرهیز از توهین» تصویربرداری در مکان عمومی را به عنوان اصل پذیرفته و برای این جواز، مبانی مختلفی از جمله «رضایت ضمنی شخص»، «آزادی بیان» و «ضرورت اجتماعی» بیان کردهاند. در نظام حقوقی ایران، تصویربرداری بدون تمرکز بر چهره خاص مجاز محسوب میشود زیرا این نوع تصویربرداری، تجاوز به حریم خصوصی نبوده و موجب تصرف در حق دیگری نمیشود. همچنین میتوان گفت تصویربرداری از اشخاص، به منظور حفظ منفعت عمومی و دفع ضرر، مستند به «اصل 24 و40 قانون اساسی»، «قانون مطبوعات» و مبانی فقهی مانند «قاعده تسلیط» و «لاحرج»، با رعایت «حفظ حقوق شخصیت»، قابل پذیرش است.<br>   The image right is one of the human personality rights that according to it, the possibility of Photography and publishing of the image falls within the scope of one's authority. Therefore, photographing and publishing of the image requires the consent of the person subject to the image. However, this right is not absolute and is limited to public places. Other legal systems have accepted shooting in a public place as a principle, provided that privacy protected and no offense is made. They have stated various Foundations for this permission, including "implied consent", "freedom of expression" and "social necessity". In the Iranian legal system, photography without focusing on a specific face is allowed, because this type of photography is not a violation of privacy and does not lead to the seizure of another's right.
