fa آیین دادرسی حاکم بر جرایم اشخاص حقوقی در مرحله تحقیقات مقدماتی در حقوق ایران و فرانسه حقوق کیفری و جرم شناسی Criminal Law تحقیقات بنیادی یا نظری Research قانون مجازات اسلامی در ماده 143، مسئولیت کیفری اشخاص حقوقی را پیش بینی نموده است. از آنجایی که رسیدگی به جرایم ارتکابی این اشخاص مستلزم وجود آیین دادرسی کیفری متناسب با ماهیت آن&shy;ها بوده، قانون آیین دادرسی کیفری به پیروی از قانون فرانسه با تخصیص بخشی مجزا قواعدی را وضع نموده است. مقررات اختصاصی تدوینی توسط مقنن در قانون آیین دادرسی کیفری 92 عمدتاً حول محور اقدامات تحقیقی از متهم شخص حقوقی بوده که در پی سازگار نمودن اقدامات تحقیقی با ماهیت این اشخاص می&shy;باشد. بنابراین پیش بینی قواعد مربوط به احضار، تفهیم اتهام، قرارهای تأمین کیفری و ... گامی مثبت در عرصه قانونگذاری جدید محسوب گردیده و سایر مواردی که در قانون به آنها اشاره&shy;ای نشده،تحت شمول قواعد عامی قرار می&shy;گیرد که درخصوص اشخاص حقیقی نیز اعمال می گردد. بدیهی است این قواعد خاص دارای خلاءهایی نیز می&shy;باشد. از جمله آنکه در بحث قرارهای تامین کیفری اشخاص حقوقی، برخلاف قانون آیین دادرسی کیفری فرانسه، هیچیک از قرارها با هدف جبران خسارات بزه&shy;دیده وضع نگردیده است. در این پژوهش تلاش شده تا قواعد خاص مربوط به تحقیقات مقدماتی اشخاص حقوقی را به نقد و تحلیل کشانده و با طرح ابهامات و ایرادات مربوطه راه حل&shy;های متناسب پیشنهاد گردد. <span style="font-size:10pt"><span style="text-justify:inter-ideograph"><span style="unicode-bidi:embed"><span cambria="" style="font-family:"><span garamond="" style="font-family:">Preliminary investigation is the focus of the criminal process, the result of which affects subsequent stages of the trial. Balancing the rights of the accused and investigative actions have always been a challenge to legal systems. This challenge has become more apparent with the emergence of legal entities as the accused. In general, the investigation process and the accused&#39;s rights regarding legal persons are subject to general rules, except in cases that are incompatible with the nature of these persons or specifically predicted by the legislator. The right to have a lawyer, study and access the case, and remain silent can be considered as the rights of legal persons. Moreover, summon, arraignment, and criminal security orders are among the investigative actions with special regulations for legal persons. This paper used an analytical-descriptive approach to examine the regulation of the rights of the legal accused and investigative actions with a comparative view of French law.
