fa ماهیت قراردادهای مشارکت عمومی خصوصی حقوق خصوصی Pivate Law تحقیقات بنیادی یا نظری Research <h1 dir="RTL">چکیده</h1> در تبیین ماهیت مشارکت عمومی خصوصی در جستجوی پاسخ به این سوال بوده&shy;ایم که مشارکت عمومی خصوصی در قالب کدام عمل حقوقی قرار میگیرد، تابع حقوق اداری است یا خصوصی و حامل چه خصایصی است که آن را متمایز میکند، با تبیین مفهوم مشارکت، تعریف قرارداد دولتی ، اداری و مشارکت عمومی خصوصی، نسبت قرارداد مشارکت عمومی خصوصی با قراردادهای اداری و مدنی بررسی شد و نهایتاً حاصل این بود که مشارکت عمومی خصوصی با وجود اینکه به سبب ذات عمومی بودن موضوع و یکی از طرفین قرارداد مشمول محدودیت هایی است ولی نمیتوان آنها را کاملا ًمستقل از قواعد عمومی حاکم بر قراردادهای خصوصی دانست بنابراین با وجود اینکه عقد معین نیستند دارای ماهیتی خاص بوده حد وسطی برای قراردادهای عمومی و قراردادهای خصوصی محسوب میشوند.<br> &nbsp; <span style="font-size:10pt"><span style="text-justify:inter-ideograph"><span style="unicode-bidi:embed"><span cambria="" style="font-family:"><span garamond="" style="font-family:">To explain the public-private partnership matter, we have to search about the answer to this question: public-private partnership Is subject to what kind of legal contracts? private law? Administrate law? And what kind of Outstanding features make it different from other contracts. In order to find the answer, we Explained the concept of partnership, the definition of governmental contract, administrative contract, and the relation between public-private partnership and civil law contract and administrate contract. Eventually, the conclusion is that although the public-private partnership is a result of the fact that publicity of the subject and contract parties has limitations but they aren&rsquo;t independent of common rules of civil law contracts.
