fa تأملی بر رأی داوری خارجی ازمنظر کنوانسیون نیویورک درمورد شناسایی و اجرای آراء داوری خارجی (1958) حقوق خصوصی Pivate Law پژوهش كاربردي Applicable Research <div style="text-align: justify;">کنوانسیون شناسایی و اجرای احکام داوری خارجی نیویورک مورخ 1958 سندی فراگیر در جهت تسهیل آرای صادره از نهاد داوری می باشد. مطابق ماده 1 سند مذکور، کنوانسیون نیویورک در مورد آرای صادره در کشوری غیر از کشور محل درخواست اجرا اعمال می شود و یا نسبت به آرایی که در کشور متقاضی عنه داخلی محسوب نشود. بدین ترتیب مشاهده می گردد که محدوده اعمال کنوانسیون تا حد بسیار زیادی وابسته به مفهوم &quot;رای داور&quot; و &quot;رای داوری خارجی&quot; است. چرا که این دو عبارت تعیین کننده آرایی است که مشمول قواعد کنوانسیون بوده و می توانند از مزایای اجرایی آن بهره مند گردند. به علاوه مفهوم رای خارجی مفهومی نسبی است و به تشخیص دادگاه مجری رای داور بستگی دارد. حال آن که هیچ تعریف صریحی از رای داوری خارجی در کنوانسیون نیویورک ارائه نگردیده است. لذا روشن نمودن مفهوم رای داور خارجی به عنوان یکی از ضروریات تعیین قلمرو اجرایی کنوانسیون در این مقاله انجام می شود.</div> <span style="font-size:10pt"><span style="text-justify:inter-ideograph"><span style="unicode-bidi:embed"><span cambria="" style="font-family:"><span garamond="" style="font-family:">The Convention of Recognition and Enforcement of Foreign Arbitral Awards, New York 1958, is a comprehensive instrument that facilitates the enforcement of decisions of the arbitration body. In accordance with Article1, this convention is applied to a State other than the State where the recognition and enforcement of such awards are sought, or to arbitral awards not considered as domestic awards. Therefore, the scope of the application of this convention depends on the notion of &ldquo;arbitrator&rsquo;s award&rdquo; and &ldquo;foreign arbitration award&rdquo;; because these two notions can determine the awards which should be executed under the rules of the convention and gain its benefits. Additionally, the concept of foreign award is relatively dependent upon recognition of the court that wants to enforce it. However, the convention gives no clear definition of the foreign arbitration award.
