fa چالش‌های ناشی از اجمال قانون مجازات اسلامی در مرحله اجرای مجازات جایگزین حبس حقوق کیفری و جرم شناسی Criminal Law پژوهش كاربردي Applicable Research نظام قضایی ایران به لحاظ نسبتاً نوظهور بودن مسأله مجازات&shy;های جایگزین حبس، همواره با چالش&shy;های قانونی گوناگونی حسب مورد در مرحله تعیین و یا اجرای آنها مواجه بوده است. نگارندگان با روش تحلیلی و کتابخانه&shy;ای و با آگاهی از گسترده بودن طیف چالش&shy;های قانونی پیرامون موضوع هم از لحاظ جنبه و قلمرو، تنها به جنبه&shy; و قلمرو خاصی از چالش&shy;های قانونی ناشی از اجمال قوانین در مرحله اجرای مجازات&shy;های جایگزین حبس در حقوق ایران پرداخته که نتایج آن حکایت از این دارد که جنبه&shy;های چالشی ناشی از اجمال قوانین در باب اجرای مجازاتهای جایگزین حبس در قالب هشت مورد به ترتیب: دامنه شمول ماده 77 ق.م.ا از حیث نوع مجازات، جبران خسارت جسمانی وارده بر محکوم&shy;علیه مجازات خدمات عمومی رایگان، ساز و کار نظارت بر اجرای مجازات توسط نهادهای پذیرنده، اخذ تأمین در حین اجرای مجازات، تعیین مجازات قابل اجرا در صورت تعذر اجرای مجازات جایگزین حبس، شرایط و دامنه شمول تخفیف مجازات موضوع ماده 483 ق.آ.د.ک، فقدان پیش&shy;بینی ضمانت اجرا در صورت ارتکاب جرم عمدی در حین اجرای مجازات و وجود مانع در جمع بین چهار ساعت خدمت شاغلین با شغل آنها، شناسایی شده و دستگاه قضایی را در عمل با مشکل مواجه ساخته است.<br> &nbsp; &nbsp; <div><span style="font-size:10pt"><span style="text-justify:inter-ideograph"><span style="unicode-bidi:embed"><span cambria="" style="font-family:"><span garamond="" style="font-family:">Due to the relatively emerging issue of alternatives to imprisonment, the Iranian judicial system has always faced various legal challenges, as the case may be, in the process of determining or implementing them.
