fa سیاست جنایی حاکم بر نهاد متولی پیشگیری و مبارزه با قاچاق کالا و ارز در حقوق ایران حقوق کیفری و جرم شناسی Criminal Law پژوهش كاربردي Applicable Research <div style="text-align: justify;"><span dir="RTL" lang="FA" style="font-size:13.0pt"><span style="font-family:IRLotus">سیاست جنایی حاکم بر مبارزه با قاچاق کالا و ارز اصولاً بر پایه پاسخ‌های دولتی اعم‌از کیفری و غیرکیفری استوار است، لیکن به جهت چندوجهی بودن این پدیده و ضرورت کاهش آسیب</span></span><span lang="FA" style="font-size:13.0pt"><span style="font-family:IRLotus">&lrm;های مترتبه، دولت راهی جز توسل به اقدامات پیشگیرانه و مشارکت جامعه مدنی در فرایند پیشگیری و مبارزه با این پدیده ندارد. ستاد مبارزه با قاچاق کالا و ارز به‌عنوان متولی اصلی این حوزه، سیاست‌ها، برنامه‌ها و اقدامات مختلفی در راستای پیشگیری و مقابله با قاچاق کالا و ارز اتخاذ کرده و تا حدودی در مهار این پدیده به دستاوردهای نائل شده، لیکن کماکان حجم قاچاق ورودی و خروجی به- از کشور بسیار چشم‌گیر و حدود 13 میلیارد دلار برآورد می‌شود که این امر مؤید وجود خلأها، چالش‌ها و موانع جدی در سیاست جنایی متخذه است. در این پژوهش ضمن تبیین اصول و مکانیزم پیشگیرانه اتخاذی ستاد، کارکرد و جایگاه ستاد در ساختار مقرره‌گذاری حوزه قاچاق کالا و ارز مورد تحلیل قرار گرفته، سپس سیاست جنایی متخذه پیرامون انواع کالاهای قاچاق مورد بررسی قرار می‌گیرد و در نهایت مهم‌ترین چالش‌های پیش‌روی سیاست جنایی ستاد در عدم توفیق کامل در مبارزه با این جرم مورد بررسی و تحلیل قرار خواهد گرفت.</span></span></div> <div style="text-align: justify;"><span style="font-size:10pt"><span style="text-justify:inter-ideograph"><span style="unicode-bidi:embed"><span cambria="" style="font-family:"><span garamond="" style="font-family:">The criminal policy governing the combating smuggling of goods and currency is mainly based on government responses, both criminal and non-criminal.
