fa تحلیل ماده 567 قانون مجازات اسلامی، با نگرشی تطبیقی به‌نظام حقوقی انگلستان حقوق کیفری و جرم شناسی Criminal Law تحلیلی و انتقادی Critical & Analisis <div style="text-align: justify;"><span style="font-size:10pt"><span style="direction:rtl"><span style="unicode-bidi:embed"><span garamond="" style="font-family:"><span lang="FA" style="font-size:13.0pt"><span style="font-family:IRLotus">ماده 567 قانون مجازات اسلامی مصوب 1392، با یک نوآوری نسبت به قانون سابق، رفتار جدیدی را جرم‌انگاری کرده است که برمبنای ماده مذکور، این رفتار عبارت از نقض حریم خصوصی جسمانی دیگری و ارتکاب عمدیِ رفتاری فیزیکی علیه جسم او است؛ این رفتار، هرچند ممکن است منجربه آسیب معنوی در مجنی‌علیه شود، اما اثری از خود در بدن او باقی نمی‌گذارد. این جرم وجوه اشتراک قابل‌توجهی با یکی از جرایم کامن‌لا در حقوق انگلستان با عنوان تحمیل نیروی غیرقانونی علیه دیگری (</span></span>Battery<span lang="FA" style="font-size:13.0pt"><span style="font-family:IRLotus">) دارد. بررسی عناصر متشکله این جرم در حقوق انگلستان و تطبیق آن‌ها با ماده مذکور و همچنین مطالعه نقاط اشتراک و افتراق این دو جرم، ابعاد جدیدی از ماده قانونی مورد بحث را در نظام حقوقی کشورمان نشان می‌دهد که تاکنون موردتوجه قرار نگرفته است. به‌علاوه، به‌نظر می‌رسد که ماهیت ضمانت اجرایی که ماده 567 قانون مجازات اسلامی مصوب 1392 برای ارتکاب رفتار موضوع آن ماده درنظر گرفته است، تنها مجازات نبوده و دارای جنبه جبران خسارت نیز می‌باشد</span></span><span lang="FA" style="font-size:13.0pt"><span style="font-family:IRLotus">.</span></span></span></span></span></span><br> &nbsp;</div> <div style="text-align: justify;"><span style="font-size:10pt"><span style="text-justify:inter-ideograph"><span style="unicode-bidi:embed"><span cambria="" style="font-family:"><span garamond="" style="font-family:">The article 567 of the Iranian Islamic penal code, with an innovation towards the former law, has criminalized a new behavior which is encroaching on other&rsquo;s bodily privacy and imposing intentional physical force on his body. This behavior, although may lead to spiritual injury in victim, leaves no effect in his body. This crime has considerable unity aspects with a criminal offence in the English legal system entitled &quot;Battery&quot;. Scrutiny the elements of this crime in the English legal system and comparing it with the mentioned article and also studying the similarities and differences between these two crimes, shows new aspects of the mentioned article in our country&rsquo;s legal system; Aspects which has not been considered so far.
