fa تحلیل حقوقی تحریم مالی هدفمند اشخاص و گروه های تروریستی حقوق کیفری و جرم شناسی Criminal Law تحقیقات بنیادی یا نظری Research تحریم مالی هدفمند اقدامی است که از سوی دولت&shy;ها یا نهادهای بین&shy;المللی نسبت به اشخاص و نهادهای با ویژگی&rlm;های خاص اعمال می&shy;شود تا از طریق محدودیت این اشخاص و نهادها در دسترسی به منابع و خدمات مالی، مانع اقدامات خطرناک آن&shy;ها شوند. سؤال اصلی پژوهش حاضر این است که ماهیت حقوقی تحریم&shy;های مالی هدفمند چیست و در رابطه با اشخاص و گروه&shy;های تروریستی، این تحریم&shy;ها چگونه در نظام حقوقی کشور مورد استفاده قرار می&shy;گیرد؟ پژوهش حاضر نشان می&shy;دهد که بسیاری از انتقاداتی که به این ابزار حقوقی وارد شده است؛ نظیر نامعین بودن آن، محرومیت اشخاص از حق دادرسی و حق دفاع و غیره وارد نبوده و ناشی از خلط ماهیت این نهاد با مجازات می&shy;باشد.&nbsp;<span dir="RTL">. استفاده از ابزار تحریم مالی هدفمند برای جلوگیری از تأمین مالی تروریسم، مستلزم تغییر در تعریف جرم تأمین مالی تروریسم است، به نحوی که در تعریف این جرم، علاوه بر تأمین مالی اعمال تروریستی، باید تأمین مالی اشخاص و سازمان&shy;های تروریستی نیز مد نظر قرار گیرد. </span><span dir="RTL">این امر سبب می&shy;شود که مقامات ذی&shy;صلاح برای مسدودکردن دارایی اشخاص موضوع فهرست اشخاص و سازمان&shy;های تروریستی، نیازی به احراز و اثبات ارتباط بین وجوه و اموال این اشخاص با یک عمل تروریستی مشخص نداشته باشند.</span> Targeted financial sanctions are actions taken by governments or international institutions against persons and entities with specific characteristics to prevent them from engaging in dangerous activities by restricting their access to financial resources and services. The main question of the present study is what is the legal nature of targeted financial sanctions and how it is applied in the legal system? This study shows that many of the criticisms that have entered into this type of sanctions; Like its uncertainty, the deprivation of persons of the right to trial and the right to defense, etc. is incorrect and is due to the confusion of the nature of this institution with punishment.&nbsp;The use of targeted financial sanctions to prevent the financing of terrorism requires a change in the definition of the crime of terrorist financing, so that in the definition of this crime, in addition to financing terrorist acts, the financing of terrorist organizations and individual terrorists must also be considered.&nbsp;This would result that the competent authorities do not need to establish and prove the connection between the funds and other assets of these persons with a specific terrorist act in order to freezing&nbsp;their property.<span dir="RTL"></span><span dir="RTL"></span> تحریم مالی, تحریم مالی هدفمند, تأمین مالی ترویسم, اقدامات تروریستی.
