fa هوشمندسازی پیشگیری از قاچاق کالا، جلوه‌ها و چالش‌ها حقوق کیفری و جرم شناسی Criminal Law تحقیقات بنیادی یا نظری Research <div style="text-align: justify;"><span style="font-size:10pt"><span style="direction:rtl"><span style="unicode-bidi:embed"><span cambria="" style="font-family:"><span lang="FA" style="font-size:13.0pt"><span style="font-family:IRLotus">امروزه، هوشمندسازی فرایند واردات و صادرات کالا به‌عنوان ابزار فناورانه کنترل و کاهش خطر ارتکاب قاچاق کالا موردتوجه کارگزاران سیاست جنایی قرار گرفته است؛ ازاین‌رو، به‌کارگیری سامانه‌های اطلاعاتی، موضوع مواد 5 و6 قانون مبارزه با قاچاق کالا و ارز و آئین‌نامه‌ اجرایی این مواد، اهمیت دوچندانی یافته است. در این نوشتار با مطالعۀ‌ کتابخانه‌ای و روش توصیفی- ‌تحلیلی، ضمن بررسی مبانی، کارکرد و جلوه‌های سامانه‌ای شدن پیشگیری از قاچاق کالا، به موانع و چالش‌های موجود بر سر راه این دست از رهیافت‌های نوین فناورانه پرداخته شده است. آنچه از این پژوهش حاصل شده، آن است که هرچند از حیث سیاست‌گذاری خطرمدارانه، رویکرد مناسبی به‌منظور ارتقای سطح شفافیت اطلاعات و مدیریت زنجیره تأمین اتخاذ شده و این راهبردها نقش مؤثری در کاهش قاچاق کالا داشته است. با این ‌حال در عمل شاهد اجرای مناسب راهبردها توسط نهادهای متولی امر نیستیم و هماهنگی لازم بین اجزای مختلف نظام عدالت کیفری وجود ندارد</span></span><span lang="FA" style="font-size:13.0pt"><span style="font-family:IRLotus">.</span></span><span lang="FA" style="font-size:13.0pt"><span style="font-family:IRLotus"><span style="letter-spacing:-.1pt"> </span></span></span></span></span></span></span><br> <span style="font-size:10pt"><span style="direction:rtl"><span style="unicode-bidi:embed"><span garamond="" style="font-family:"><span lang="FA" style="font-size:13.0pt"><span style="font-family:IRLotus"><span style="letter-spacing:-.1pt">&nbsp;</span></span></span></span></span></span></span></div> <div style="text-align: justify;"><span style="font-size:10pt"><span style="text-justify:inter-ideograph"><span style="unicode-bidi:embed"><span cambria="" style="font-family:"><span garamond="" style="font-family:">Today, goods import and export process smartization has been considered by the criminal policy agents as a technological tool to control and reduce the risk of smuggling. Hence, utilizing information systems, the subject of Articles 5 and 6 of the Action against Goods and Currency Smuggling act, and the regulations of these articles have become significantly important. This paper reviews the challenges and the obstacles in the way of these modern and technological approaches by using library study and descriptive-analytical method while exploring the principles, functions, and the effects of the smuggling of goods prevention systematization.
