fa بررسی مفهوم جنایت تجاوز ارضی با تأکید بر قطعنامه ی مصوب کنفرانس بازنگری کامپالا حقوق خصوصی Pivate Law گردآوری و مروری Revision & Collection <p align="justify" style="DIRECTION: rtl">&nbsp; با وجود تأسیس دیوان کیفری بین&rlm;المللی و لازم&rlm;الأجرا شدن اساسنامه&rlm;ی آن، هنوز برخی از حوزه&rlm;های عملیاتی این دیوان در هاله&rlm;ای از ابهام قرار دارد؛ یکی از مسائل عمده در مورد صلاحیت موضوعی دیوان مزبور بر جنایت تجاوز ارضی است که به دلایل مختلفی صلاحیت بالفعل دیوان بر این جنایت هنوز به نحو کاملی میسر نشده است؛ در عین حال، در کنفرانس رم توافق شد که تعریف، عناصر آن و شروط اعمال صلاحیت دیوان بر این جنایت در کنفرانس بازنگری مشخص شود. در کنفرانس بازنگری کامپالا (2010) نیز اعمال صلاحیت دیوان کیفری بین&rlm;المللی بر این جنایت، اعمال صلاحیت واقعی دیوان، به تصمیم دولت&rlm;های عضو بعد از اول ژانویه&rlm;ی 2017 موکول گردیده است. مشکل عمده در زمینه&rlm;ی اعمال صلاحیت دیوان بر این جنایت علاوه بر تعریف و عناصر متشکله&rlm;ی آن، چگونگی تنظیم رابطه و عملکرد دیوان کیفری بین&rlm;المللی و شورای امنیت در مورد احراز وقوع عمل تجاوزکارانه&rlm;ی ارتکابی و دیگر اختیاراتی است که مطابق با اساسنامه&rlm;ی دیوان به شورای امنیت واگذار شده است.</p> <p>&nbsp; Despite the formation of International Criminal Court and entering into force of its Statute, There is Some Ambiguity on Certain Fields of its Activities. One the most important ambiguity is about the subject matter of the jurisdiction of the Court on the crime of aggression. This ambiguity is due of the political and legal nature of the crime of aggression and insufficient agreement of the international community on the definition of this crime.</p> <p>&nbsp; Notwithstanding of the recognition of the legality of the crime of aggression and the criminal responsibility of its perpetrators, the Rome Conference agreed the above crime and its definition, elements and the conditions of its exercise should be defined in the Review Conference of its statute.
