fa تعهدات دولت ها در خصوص فعالیت های شرکت های خصوصی ماهواره های کوچک حقوق بین الملل International Law پژوهش كاربردي Applicable Research <div style="text-align: justify;"><span dir="LTR"></span>ماهواره‌های کوچک به‌دلیل مزایای بسیاری که در مقایسه با ماهواره‌های بزرگ دارند، کنشگران غیردولتی بسیاری را در سال‌های اخیر وارد حوزۀ فضا کرده‌اند. فعالیت‌های ماهواره‌های کوچک نیز مانند هر فعالیت فضایی، پُرخطر می‌باشد و ممکن است موجب ورود خسارت شود. چنانچه از فعالیت‌های فضایی شرکت‌های خصوصی پرتاب‌کنندۀ ماهواره‌های کوچک خسارتی وارد آید، مطابق معاهدات فضایی موجود، این دولت‌ها هستند که مسئول شناخته می‌شوند. مبنای این مسئولیت مادۀ 6 معاهدۀ فضای ماورای جو است. وفق این ماده دولت‌های عضو در قبال فعالیت‌های نهادهای غیردولتی در فضای ماورای جو مسئولیت بین‌المللی دارند. دولت مناسب می‌بایست مطابقت فعالیت‌های انجام‌شده با مقررات معاهدۀ مذکور را تضمین، به فعالیت‌های فضایی ملی مجوز اعطا و بر آن به‌طور مستمر نظارت کند. در این نوشتار با گردآوری داده‌های کتابخانه‌ای و روش توصیفی تحلیلی سعی شده است تعهدات دولت در قبال فعالیت‌های شرکت‌های خصوصی ماهواره‌های کوچک مشخص شود. بدین منظور ماده 6 معاهدۀ فضای ماورای جو و نحوه اجرای تعهدات ناشی از آن&nbsp; در قوانین ملی فضایی کشورهای ایالات‌ متحدۀ امریکا، بلژیک، هلند، اتریش و نیز مقررات جمهوری اسلامی ایران بررسی شده است.</div> <div style="text-align: justify;"><span style="line-height:normal"><span style="font-size:10.0pt"><span garamond="" style="font-family:">In recent years, small satellites have brought many non-governmental actors into outer space domain because of many advantages they offer in comparison with large satellites. The activities of small satellites, like any space activity, are high-risk and may cause damage. Under the existing space treaties, it is States that are held liable if the space activities of private companies launching small satellites cause damage. The basis is Article VI of the Outer Space Treaty. According to this article, member States have an international responsibility for activities of non-governmental entities in the outer space. The appropriate State shall guarantee compliance of activities carried out with the provisions of the Treaty, authorize and continuously supervise national space activities. By collecting library data and descriptive-analytical method, this research tries to determine the State&#39;s obligations towards the activities of private companies of small satellites.
