fa تعهد به ارائه اطلاعات و همبستگی قراردادی Obligation to provide information and contractual solidarity حقوق خصوصی Pivate Law پژوهش كاربردي Applicable Research <div style="text-align: justify;">جهان قراردادی هر روز شاهد تقویت بُعد رابطه‌‌ای قرارداد و اخلاق‌‌رابطه‌‌ای در آن می‌‌باشد. ازجمله پیامدهای چنین ‌‌توجهی، طرح مبانی جدید به‌منظور تأمین حداکثری عدالت‌‌ قراردادی بوده که ازجمله مهم‌ترین آن‌ها، مبنای همبستگی ‌‌قراردادی است. مبنایی که دربردارنده الزام توجه به منافع اطراف ‌‌عقد در حقوق و تعهدات ‌‌قراردادی و به‌ویژه در تعهد ارائه ‌‌اطلاعات است که در نظام حقوقی-قضایی ایران براساس مقدمه قانون اساسی و اصول 2 و 3 آن قابل‌توجیه است. تعهد به ارائه ‌‌اطلاعات بر مبنای جدید همبستگی از مبانی نقص‌‌ رضایت و حُسن‌‌نیت که صرفاً به تعهد پیش‌‌قراردادی اطلاع‌‌رسانی محدود می‌‌شد، عبور کرده و ضمن شمول تمامی مراحل حیات قراردادی، علاوه‌بر تعهد به آگاه کردن، تعهد ‌‌اخطار و تعهد‌‌ مشاوره را نیز در‌‌برمی‌‌گیرد. در تعهد به آگاه کردن، با ارائه اطلاعات به‌صورت خام امتثال تکلیف شده و درجه پائینی از توجه به منافع شریک ‌‌قراردادی مطرح است. لیکن در تعهد ‌‌اخطار، علاوه‌بر ارائه اطلاعات، تأکید به جوانب منفی و خطرها و ریسک عمل حقوقی طرح شده و در تعهد ‌‌مشاوره از این هم فراتر رفته و تلاش می‌‌شود تا با همکاری متعاقدین، تصمیم اطراف‌‌ عقد به سمت مناسب‌ترین اقدام جهت‌‌دهی شود که در این قِسم از تعهد ارائه ‌‌اطلاعات و درصورت ایجاب شرایط، تعهد به انصراف از انعقاد عقد که به نوعی با اصل منع‌‌ مداخله در امور اشخاص نیز برخورد دارد، مطرح می‌‌شود، امری که توجه به منافع اطراف‌‌ عقد در آن کاملاً مشهود است.  </div> <div style="text-align: justify;">The contracting world is witnessing the strengthening of the contractual dimension and the ethics ofthe relationship in it every day. One of the consequences ofsuch attention is the design of new foundations in order to ensure maximum contractual justice, one ofthe most important of which is the solidarity-contractual basis. The basis is the obligation to pay attention to the interests of the contractors in the rights and obligations of the contract, and in particular in the obligation to provide information, which is justified in the Iranian legal system based on the introduction of the Constitution and its principles 2 and 3. Obligation to provide information on a new basis transcends the principles of satisfaction and good¬¬faith, which were limited to the pre-contractual obligation of information, and includes all stages ofthe contractlife. In addition tothe obligation to teach, It also includes the obligation to give notice and the obligation to advise. In the obligation to teach, obedience is provided by providing information in a crude form and a low degree of consideration is given to the interests of the contracting partner.
