fa تحلیل رابطه ریاضی با حقوق: با تمرکز بر منابع حق و تکلیف و نظریه عدالت حقوق عمومی General Law تحقیقات بنیادی یا نظری Research <div style="text-align: justify;">حقوق را می‌توان مجموعه قواعد تنظیم عادلانه رفتار و روابط اشخاص، همراه با ضمانت اجرا دانست. هم‌زمان با پیدایش و توسعه حقوق، ریاضیات، از راه‌های گوناگون با آن رابطه داشته است. ساده‌ترین و پُرکاربردترین سطح رابطه ریاضی با حقوق، قلمرویی است که از علم ریاضی برای حل مسائل عملی/ موردی حقوقی و قضائی استفاده می‌شود. این سطح از رابطه را نمی‌توان به‌معنای پیدایش یک نظام علمی میان‌رشته‌ای دانست؛ زیرا کاربرد ریاضیات در علوم و در حوزه‌های مختلف زندگی بشر، امری رایج است. در زمینه رابطه ریاضیات با علم حقوق، هدف پژوهش حاضر، کاوش این مسأله است که علم ریاضی در منابع حق و تکلیف و در دکترین حقوقی دارای چه آثاری می‌تواند باشد؟ این پژوهش در گردآوری اطلاعات، به‌صورت کتابخانه‌ای و در تحلیل اطلاعات، از ترکیبی از منطق حقوقی و روش‌ها و فرمول‌های ریاضی و از روش‌های تحلیل آماری بهره جسته است. اثربخشی علم ریاضی در منابع حق و تکلیف &ndash; مانند قانون &ndash; را می‌توان گام اساسی شکل‌گیری علم [ریاضی &ndash; حقوق] دانست. علم [ریاضی &ndash; حقوق] با کاوش و تنظیم مستمر اثربخشی علم ریاضی در دکترین حقوقی، در روند ارتقاء، گسترش و تعمیق قرار می‌گیرد و از این طریق، کارایی و اثربخشی منابع حق و تکلیف نیز در راستای تحقق عدالت پویا، در مسیر ارتقاء مستمر قرار می‌گیرد. به این ترتیب، پژوهش منجربه مقاله حاضر نشان داده است که علم ریاضی قابلیت کافی برای تشخیص، تنقیح و تنظیم منابع حق و تکلیف و برای توسعه و پیشرفت اصول، قواعد و نظریه‌های حقوقی را دارد. پیشنهاد این مقاله طراحی علم تعامل بین ریاضی با حقوق می‌باشد: [ریاضی &ndash; حقوق]. <span style="font-family:IRLotus"></span><br> &nbsp;</div> <div style="text-align: justify;"><span style="line-height:normal"><span style="font-size:10.0pt"><span garamond="" style="font-family:">&ldquo;Law&rdquo; can be defined as a set of the rules for regulating the behavior of the legal persons and their communication, according to the equity, with the sanction. The Law from its inception, and through its development, had relation with mathematics in several different ways. The simplest and the most applied area of the relation is the area in which the mathematics is applied for solving the actual problems of legal and judicial substance. This level of relation cannot be regarded to as a scientific interdisciplinary system, because the application of the mathematics is a normal method in different areas of human life. In the context of the relation of mathematics and the law, the aim of this research is searching the potential effects of the mathematics on the sources of the rights and obligations, and on the legal doctrine. Information collecting is from library and information analizing is based on a combination of the legal logic and the methods and formulas of the mathematics and the methods of statistical inference. The effectiveness of the science of mathematics in the sources of right &ndash; obligation, like the acts and the statutes, can be regarded as the basic step for the constitution of the science of [Mathematics &ndash; Law]. The science of [Mathematics &ndash; Law] will be in the trend of development, through the research and regulation of the effectiveness of the law. This leads to the enhancement of the sources of the right and obligation in the course of the dynamic equity.
