fa علل بروز اختلاف در قراردادهای پیش فروش ساختمان و راهکارهای پیشگیری از آن حقوق خصوصی Pivate Law پژوهش كاربردي Applicable Research <div style="text-align: justify;">امروزه &nbsp;اختلافات در فروش ساختمان و واحدهای آپارتمانی پیش از ساخت یکی از معضلات رایج در جامعه است که بستگی به قراردادهای پیش‌فروش یا پیش‌ساخت دارد. طولانی‌بودن مدت پروژه های عمرانی و نوسانات قیمت مواد و مصالح به‌ویژه با توجه به شرایط بی‌ثبات اقتصادی امروز یکی از دلایل مهم اختلافات فراوان و مانعی در توسعه قراردادهای پیش‌فروش در ایران است. بدون درنظر گرفتن شرایط خارج از اراده طرفین، موضوعات قراردادی و غیرقراردادی بسیاری با توجه به پیچیدگی چندبُعدی بودن قراردادهای پیش‌فروش، موجب اختلاف طرفین در انجام تعهدات چنین قراردادهایی است. در این پژوهش عواملی که موجب بروز اختلاف در قراردادهای مربوط به اموال غیرمنقول (به‌طور عام) و قراردادهای پیش‌فروش (به‌طور خاص) می‌گردد، بررسی می‌شود. <span style="font-family:IRLotus"></span><br> همچنین راهکارهایی به‌منظور جلوگیری از وقوع اختلاف در قراردادهای پیش‌فروش ساختمان ارائه شده است که به‌نظر می‌رسد ثبت رسمی قراردادهای پیش‌فروش ساختمان یکی از مهم‌ترین راهکارها می‌باشد. به‌طورکلی در این پژوهش، صرف‌نظر از نوع و ماهیت قراردادهای پیش‌فروش، به‌صورت توصیفی- تحلیلی به شناسایی عوامل بروز اختلاف و راه‌های جلوگیری از این اختلافات&nbsp; پرداخته شده است.</div> <div style="text-align: justify;"><span style="line-height:normal"><span style="font-size:10.0pt"><span garamond="" style="font-family:">Today, the disputes over the sale of buildings and apartment units before construction are one of the most common problems in society, which relates to pre-sale or pre-construction contracts. The long duration of construction projects and fluctuations in the prices of materials, especially due to the unstable economic conditions at the present time, is one of major reasons for the increased number of disputes and obstacles in the development of pre-sale contracts in Iran. Regardless of the circumstances which are beyond the control of the contracting parties, many of the contractual and non-contractual issues, due to the multi-dimensional complexity of the pre-sale contracts, cause the disputes between the contracting parties in fulfilling the obligations of such contracts. This paper aims to identify and assess the major factors that cause disputes in contracts related to immovable assets (in general) and pre-sale contracts (in particular).</span></span></span><br> <span style="font-size:10.0pt"><span style="line-height:107%"><span garamond="" style="font-family:">Furthermore, a number of solutions are proposed to prevent disputes in pre-sale contracts. Formal registration of the pre-sale contracts of buildings seems to be one of the most significant solutions.
