fa الگوی مطلوب افزایش خواسته در حقوق ایران The Ideal Pattern for Increasing Demand in Iranian Law حقوق خصوصی Pivate Law گردآوری و مروری Revision & Collection <div style="text-align: justify;">در قانون آیین دادرسی مدنی، حقوقی برای خواهان در نظر گرفته شده است که تا پایان جلسۀ اول دادرسی، امکان طرح آن وجود خواهد داشت. این حقوق به‌صورت کلی به <a href="https://civilica.com/search/paper/k-%D8%AF%D8%B9%D9%88%D8%A7%DB%8C%20%D8%A7%D8%B6%D8%A7%D9%81%DB%8C-o-Title-ot-desc/" style="color:blue; text-decoration:underline" title="دعوای اضافی">دعوای اضافی</a> تعبیر می‌شود. در قانون آیین دادرسی مدنی فقط یک ماده به این موضوع اختصاص پیدا کرده و تنها به ذکر مصادیقی ازقبیل کاهش خواسته، افزایش خواسته، تغییر نحوۀ دعوا، <a href="https://civilica.com/search/paper/k-%D8%AA%D8%BA%DB%8C%DB%8C%D8%B1%20%D8%AE%D9%88%D8%A7%D8%B3%D8%AA%D9%87-o-Title-ot-desc/" style="color:blue; text-decoration:underline" title="تغییر خواسته">تغییر خواسته</a> و <a href="https://civilica.com/search/paper/k-%D8%AA%D8%BA%DB%8C%DB%8C%D8%B1%20%D8%AF%D8%B1%D8%AE%D9%88%D8%A7%D8%B3%D8%AA-o-Title-ot-desc/" style="color:blue; text-decoration:underline" title="تغییر درخواست">تغییر درخواست</a> پرداخته شده و چگونگی اجرای هر یک را صریحاً بیان نکرده است. افزایش خواسته صرفاً به‌صورت افزودن بر میزان خواستۀ مرقوم‌شده در دادخواست اصلی و بدون رعایت تشریفات معمول دادرسی، بروز خواهد کرد، در حالی که دعوای اضافی به همراه دادخواست جدید توسط خواهان مطرح و در واقع با این عمل، دعوای جدیدی جهت اشتغال دادگاه پایه‌ریزی خواهد شد. به‌طور حتم این دو نگاه متفاوت، می‌تواند بر صلاحیت مرجع رسیدگی‌کننده و قابلیت شکایت از رأی صادره، اثر ملموسی در پی داشته باشد. در این مقاله تلاش شده ضمن نگاه به فلسفۀ وجودی این دو مفهوم با برخی استنتاج‌های نوین قانونی، با ارائۀ پیشنهاد «حذف اصطلاح افزایش خواسته و تأسیس مادۀ واحده‌ای مستقل» در نظام دادرسی فعلی، گامی کوچک در جهت تبیین و ارائۀ الگوی مطلوب از افزایش خواسته، در جامعۀ حقوقی کشور بر دارد.  </div>   <div style="text-align: justify;">In the Code of Civil Procedure, rights are considered for the petitioner, which will be possible to be raised until the end of the first hearing. These rights are generally interpreted as additional lawsuits. In the Code of Civil Procedure, only one article has been dedicated to this issue and it has only mentioned examples such as reducing the demand, increasing the demand, changing the way of litigation, changing the demand and changing the request, and it has not explicitly stated how to implement each one. The increase in the demand will appear only in the form of adding to the amount of the demand in the original petition and without observing the usual court procedures, while the additional lawsuit along with the new petition will be raised by the petitioner and in fact, with this action, a new lawsuit will be established for the employment of the court. Certainly, these two different views can have a tangible effect on the jurisdiction of the investigating authority and the ability to complain about the issued decision.
