fa درآمدی بر کیفیت دادرسی در فرآیند دادرسی کارآمد حقوق خصوصی Pivate Law تحقیقات بنیادی یا نظری Research <p>&nbsp; معقول و متعارف بودن زمان و هزینه های طرح دعوای مدنی و فرآیند دادرسی را کیفیت دادرسی می نامند که باعث جریان بهینه دادرسی و کارایی آن می شود.کیفیت دادرسی، که از جمله تضمینهای بنیادین سیستم عدالت مدنی است، تأکید بر سازمان دهی مؤثر روابط حقوقی طرفین دعوا و دستگاه قضایی دارد تا از این طریق ضمن ارتقای کارکرد اجتماعی دادرسی، عدالت شکلی و ماهوی (= عدالت کارا) نیز تحقق یابد. در مقاله حاضر ابتدا به مفهوم دادرسی کارآمد و کیفیت دادرسی پرداخته و سپس، به ترتیب، به جایگاه و شاخص های کیفیت دادرسی اشاره کرده و نهایتاً به احصاء و تبیین عوامل ارتقای کیفیت دادرسی تمرکز خواهد شد.</p> <p>&nbsp; Reasonable and common time and costs of civil litigation and efficient litigation advocacy (trial) process are called the quality trial that make an optimum flow (procedure) of trial and its efficiency. Quality of trial, which is one of the fundamental guarantees in a civil trial system, emphasizes on effective organizing of legal relations litigants and judicial apparatus, therefore meanwhile the social function of trial is promoted , the substantial justice (= efficient justice) will be also achieved.</p> <p>&nbsp; In this paper, first of all, the concept of efficient trial and quality of justice is discussed and then respectively, the position and indicators for quality of trial are noted finally, it is focused on counting and explaining the promoting of quality trial factors.</p> دادرسی کارا, کیفیت دادرسی, زمان دادرسی, هزینه های دادرسی, امنیت حقوقی, امنیت قضایی.
