fa شرایط اعمال کنوانسیون قرارداد حمل و نقل بین المللی کالا از طریق جاده (CMR) حقوق خصوصی Pivate Law تحقیقات بنیادی یا نظری Research <p style="DIRECTION: rtl">&nbsp; نقش مهم حمل و نقل در گردش کالا و توزیع ثروت در عرصه بین‌الملل، تصویب مقررات یکنواخت بین‌المللی را ضروری گردانیده است. در این میان، یکی از کنوانسیونهای دارای اهمیت، کنوانسیون راجع به قرارداد حمل و نقل بین‌المللی کالا از طریق جاده معروف به CMR است. جمهوری اسلامی ایران نیز به دلیل آثار مهم اقتصادی ناشی از پیوستن به کنوانسیون، به این کنوانسیون ملحق گردیده است. به‌رغم گذشت بیش از 14 سال از تاریخ الحاق به این کنوانسیون، ادبیات حقوقی ایران از غنای کافی در این خصوص برخوردار نیست. از آن جایی که اعمال کنوانسیون بر قرارداد حمل و نقل بین‌المللی کالا مستلزم وجود شرایطی است، این جستار درصدد تبیین شرایط مزبور از حیث ماهیت، شرایط مربوط به تشکیل قراردادهای مشمول کنوانسیون، عناصر لازم برای تحقق وصف بین‌المللی حمل و نقل و شرایط مربوط به اعمال کنوانسیون بر اساس قواعد حل تعارض است.</p> <p>&nbsp; The important role of the transportation of goods and distribution of the wealth in the international scope has necessitated the enactment of unified international provisions. One of these important conventions is the Convention on the Contract for the International Carriage of Goods by Road (CMR). Islamic Republic of Iran, due to the important economic effects of joining this Convention, has joined it. Although the joining has occurred more than fourteen years ago, the Iranian legal literature is not so rich in this area. Since the application of the Convention on the contract of international carriage of goods requires some conditions, this study is going to explain those conditions with respect to their nature, the conditions of the conclusion of the contracts covered by the Convention, the necessary elements required for the &#39;international&#39; description of the carriage and also conditions of the application of the Convention on the basis of the rules of conflicts of laws.</p> قرارداد, کنوانسیون, حمل و نقل, حمل کننده, جاده ای, بین المللی.
