fa دعوای گروهی و تأثیر آن بر حمایت از حقوق مصرف‌کننده Class Action and Its Effect on the Protection of Consumer Rights   برای طرح ادعایی مشترک، دعوای گروهی از سوی افراد متعدد علیه خوانده‌ی واحد اقامه میگردد. در این شکل از اقامه‌ی دعوا، یک نفر یا بیشتر از اعضای گروه به عنوان نماینده‌ی گروه درخصوص ادعای مشترک بین اعضا، علیه یک یا چند خوانده اقامه‌ی دعوا میکنند. اعضای گروه اگرچه در بیشتر موارد نقش فعالی در دادرسی ندارند اما، به نتیجه حاصل از دادرسی ملزم خواهند بود. امروزه دعوای گروهی به عنوان یکی از اقسام طرح دعوا به صورت دستهجمعی از جایگاه ویژهای در حقوق آمریکا برخوردار است. طرح دعوا به صورت گروهی، فرصت و امکان احقاق حق برای تعداد کثیری از افرادی که به تنهایی انگیزه‌ی کافی برای پیگیری مطالبات اندک خود ندارند را فراهم میآورد. از طریق این شیوه اقامه‌ی دعوا، کارآیی سیستم قضایی افزایش مییابد و طرح دعوا از سوی تعداد زیادی از افراد، مقرون ‌به ‌صرفه جلوه مینماید. شرایط اقامه‌ی دعوای گروهی در ماده 23 قانون آیین دادرسی مدنی فدرال آمریکا و قانون منصفانه‌ی دعوای گروهی مصوب سال 2005 میلادی به تفصیل مورد بحث قرار گرفته است. دعاوی گروهی در زمینههای متعددی از قبیل حقوق مصرف&rlm;کننده، ضد انحصار، حقوق استخدامی، حقوق مدنی، محیط زیست و... طرح میشوند.     Class action is a legal procedure of a considerable group of people to take joint actions against a single defendant. In this form of action, one or more people representing while also being a member of a class, take an action for themselves and on behalf of others, regarding a common claim among the members of the class. Although the members of the class have no active role in the jurisdiction, they are bound to its result. Nowadays, class action as a form of aggregating action enjoys a special status in the States legal system. Class action provides a group of people, who does not individually have an interest in following up their trivial claims, with the opportunity to entitle their rights. The efficiency of the judicial system will enhance through this form of taking actions and seems to be economic. The prerequisites of class action have been explained in details in rule 23 of the Federal Civil Procedure Law and Class Action Fairness Act 2005.
