fa ضرورت تسلیم رأی در مدت داوری حقوق خصوصی Pivate Law پژوهش كاربردي Applicable Research <div align="justify" style="direction: rtl">مطابق مقررات جدید آئین دادرسی مدنی ایران ، چنانچه رای داور پس از اتمام مهلت داوری صادر و تسلیم گردد باطل و قابلیت اجرایی نخواهد داشت . بنابراین هر یک از طرفین داوری می تواند از دادگاه صدور حکم بر بطلان رای را خواستار گردد . این مطلب زمینه ساز اختلاف نظرهای فراوانی بین حقوق دانان گردیده است . عده ای از حقوق دانان عقیده دارند برای بطلان رای داور باید عمل صدور و تسلیم رای ، توامان خارج از مدت داوری صورت گرفته باشد لکن چنانچه داور رای خود را داخل در مدت داوری صادر و خارج از مهلت تسلیم نماید اشکالی بر رای وارد نبوده و رای صادره صحیح است . در مقابل عده ای دیگر عقیده دارند تسلیم رای خارج از مهلت داوری به منزله صدور رای خارج از مدت داوری است ، بنابراین در چنین حالتی رای داور باطل خواهد بود . به دلایلی که دراین مقاله بدان می پردازیم خواهیم دید که امکانی برای داور وجود ندارد تا خلاف این مطلب را اثبات نماید . فلذا نگارنده با تکیه بر صحت استدلال گروه دوم به تدوین این مقاله می پردازد.&nbsp;</div> According to the new rules of civil procedure of Iran, if the verdict of an arbitrator be issued and delivered after the arbitration s period, it is void and won&rsquo;t be executable. Thus every one of arbitration s party can ask the court to rescind the award. This subject caused many disagreements among lawyers .Some lawyers believe if the issue and delivery happen after determinate period for arbitration, it is void. But if an arbitrator makes his award during the time of arbitration and delivers it after period, it is valid and correct. In contrast to this view some other lawyers argue delivery of verdict after termination of arbitration s time is equal to issue of it after period .In this article, we will see that for some reason there is no possibility for an arbitrator to prove the opposite of this subject.
