fa مبانی کلامی و فقهی توبه درحقوق کیفری اسلام تحلیلی و انتقادی Critical & Analisis <p dir="RTL" style="margin: 0cm 0cm 10pt; text-align: justify; -ms-text-justify: kashida; text-kashida: 0%; tab-stops: 314.6pt;"><span style="font-family:b zar;"><span style="font-size:10.0pt;">توبه، یکی ازواژه‌های بنیادین در حقوق جزای اسلامی و ازمعاذیر قانونی معافیت از مجازات محسوب می‌شود.این مقوله که مرزی را میان حقوق اسلام و حقوق سکولار ایجادمی‌نماید، برتعدادی گزاره‌های زیرساختی ونیز تصور انسان ازخداوند استوارمی‌باشد و از دیر زمان موردتوجه دین‌پژوهان دردوحوزه کلام وحقوق بوده است.حقوقدانان ازمنظرسیاست کیفرزدایی آن را یک مسئله حقوقی تلقی نموده ومتکلمین بارویکرد تربیتی،توبه را عامل بازدارنده جرم و مرتبط بابرخی صفات الهی دانسته‌اند. در این مقاله ابتدا به تحلیل فقهی، فلسفی وکلامی توبه پرداخته و از منظر برون دینی عقلانیت،فراتاریخی و واقع گرایی احکام کیفری اسلام درراستای پویایی فقه تبیین می‌شود، در ادامه گستره توبه و رویکرد قوانین جزایی اسلام با نگاه درون دینی نیز بررسی خواهد شد.</span></span><br> &nbsp;</p> <p>Repentance is known as one of the fundamental concepts in Islamic criminal law and as a legal excuse. This issue which creates a border between Islamic laws and secular criminal schools, stands on some infrastructural propositions and human imagination of God. repentance has been considered in the attitudes of religious scholars in both scopes of theologically and legally for a long time. Lawyers recognized it as a legal issue from the perspective of decriminalizing policy, and theologians considered it as an element and attributeit to certain divine attributes with a educational approach. This article starts with the jurisprudential, philosophical and theological analysis of repentance. In radial of that, it illusterates Islamic criminal norms rationality extra historically and realistically in lines of jurisprudence&rsquo;s dynamismis explained.
