fa نقد تحریم نفت ایران از طرف اتحادیه اروپا از منظر حقوق بین الملل حقوق خصوصی Pivate Law تحقیقات بنیادی یا نظری Research <p style="DIRECTION: rtl">&nbsp; شورای اتحادیه اروپا در 23 ژانویه 2012، در راستای تشدید تحریمهای اقتصادی علیه جمهوری اسلامی ایران، تصمیم گرفت تحریمهای اقتصادی بیشتری در بخش انرژی از جمله تحریم واردات نفت خام از ایران در کشورهای عضو اتحادیه، در بخش مالی علیه بانک مرکزی ایران و هم چنین علیه اشخاص حقیقی و حقوقی وضع کند. در این میان تحریم واردات نفت خام از اهمیت بیشتری برخوردار است که لازم است، در کنار مباحث و مناقشات سیاسی و اقتصادی جاری پیرامون این تحریم نفتی، مشروعیت آن از منظر حقوق بین الملل نیز مورد بررسی قرار گیرد.<strong>&nbsp;</strong>آیا تحریم نفت اتحادیه اروپا، در راستای تحریمهای شورای امنیت علیه ایران می باشد؟ کشورها و سازمانهای بین المللی تا چه حد در تفسیر و اجرای قطعنامه های شورای امنیت صلاحیت دارند؟ هدف از این پژوهش این است که اقدام اتحادیه اروپا در خصوص تحریم نفت ایران و مشروعیت آن، از طریق تفسیر قطعنامه های شورای امنیت، اصول منشور ملل متحد و نیز مقررات اتحادیه اروپا مورد تحلیل و بررسی قرار گیرد.</p> <p>&nbsp; The European :::::union::::: council in 23 January of 2012 ,in direction to aggravate economic sanctions against Islamic Republic of Iran ,decided to enact further economic restrictions against this country in energy section such as importing oil from Iran to the state members of European :::::union::::: ,in financial section against central bank of Iran, in transportation section and also against individuals and legal entities .In the center of these sanctions oil embargo has more importance than the other sanctions that is necessary to consider its legality in international law point of view beside the political and economic arguments and disputes .The question is that how much the countries and international organizations have the capacity in interpreting and implementing Security Council sanctions? Does European :::::union::::: have right to adopt sanction higher than Security Council sanctions? What is the response of international law toward EU sanction against Iran?
