fa تحولات کیفری در قانون میهن پرستی آمریکا حقوق خصوصی Pivate Law تحقیقات بنیادی یا نظری Research <p style="DIRECTION: rtl">&nbsp; قانون میهن پرستی آمریکا، که با هدف ایجاد تغییرات بنیادین در جهت نظارت، مبارزه با تروریسم و برقراری امنیت، طرح ریزی و تصویب شده بود، موجب بروز نگرانیهای جدی در زمینه آزادیهای مدنی، به دلیل افراط در بکارگیری نظارت، جستجوی سوابق و داده ها و بکارگیری آنها گشت. صرفنظر از علت و منشأ تصویب این قانون ظرف چند هفته پس از حملات یازده سپتامبر 2001، در عمل موجب افزایش چشمگیر اختیارات و قدرت دولت، در راستای انجام تحقیقات ضد تروریسم شد. تدوین و اجرای قانون میهن پرستی، موجی از نقدهای موافق و مخالف را در این زمینه به دنبال داشت و چالشهای حقوقی و اجتماعی بسیاری را فراروی مردم و مسئولین قرار داد. موضوع نوشتار حاضر، پس ازمروری کوتاه بر تاریخچه و فصول کلی آن، بررسی تغییرات ایجاد شده در قوانین ایالات متحده آمریکا به واسطه تصویب و اجرای قانون مذکور و در نهایت جمع بندی نکات مثبت و منفی آن می باشد. بررسی این تغییرات از آن جهت حائز اهمیت است که در پاره ای از موارد عدول از مبانی نظری و تئوریهای حقوق جزا به شمار می آید و هر یک قابلیت بحث تحلیلی دیگری را دارد.</p> <p>&nbsp; The USA Patriot Act, which is projected and enacted with the purpose of creating fundamental changes in order to surveillance, combating terrorism and enhancement of security, caused serious concerns regarding civil liberties, due to the excessive use of surveillance, searching records and data and using them. The legislation of this Act within a few weeks after the September 11^th attacks, led to increased powers and authorizations of government in performing anti-terrorism investigations. The Codification and enforcement of the Patriot Act, was followed by a wave of opposing and supporting criticisms in this regard, and people and authorities were faced by many legal and social challenges.
