fa ماهیت مدیریت جریان داوری توسط مراکز داوری و قانون حاکم بر آن تحقیقات بنیادی یا نظری Research <p><strong><span style="font-style:normal;"><span style="font-family:b compset;"><span style="font-size:10.0pt;">چکیده</span></span></span></strong></p> <p style="text-align: justify;"><span style="font-style:normal;"><span style="font-family:b compset;"><span style="font-size:10.0pt;">با گسترش روزافزون اقبال به داوری تجاری بین‌المللی، نقش مؤسسات و مراکز داوری در این موضوع مورد توجه بیشتری قرار می‌گیرد. این مراکز در چارچوب قواعد و آیین‌نامه‌ها، کارکردهای مختلف برای خود در نظر می‌گیرند، از جمله‌ ارائه خدمات دفتری تا مدیریت جریان داوری. ضمن مدیریت جریان داوری، مرکز داوری مشکلات و موانع پیش‌روی تشکیل محکمه داوری و جریان رسیدگی را بر طرف کرده و بر کار داور نظارت می‌کند تا امر رسیدگی در چارچوب قواعد و مواعد مشخص انجام پذیرد. بدین ترتیب مراکز داوری بخشی از وظایف دادگاه‌های داخلی را در داوری موردی انجام می‌دهند.</span></span></span></p> <p style="text-align: justify;"><span style="font-style:normal;"><span style="font-family:b compset;"><span style="font-size:10.0pt;">در خلال مدیریت جریان داوری، مرکز گاهی تصمیماتی می‌گیرد که ماهیت قضایی دارد. اگرچه مرکز داوری در فرایند رسیدگی به اختلاف وارد نمی‌شود، اما تصمیماتش در فرآیند مدیریت جریان داوری بر نتیجه پرونده تأثیرگذار است. مرکز داوری در اداره جریان داوری تابع مقررات خود بوده، اما موظف است از مقررات امری قانون محل داوری به‌ویژه اصول دادرسی عادلانه پیروی کند. در صورت عدم رعایت اصول مذکور، امکان طرح دعوی علیه مرکز در دادگاه‌های داخلی و ابطال تصمیم مرکز یا رأی داوری صادره در آن مرکز وجود دارد.</span></span></span></p> <h2>Abstract</h2> <div style="text-align: justify;">With increasing tendency in international commercial arbitration, the role of arbitration institutes and centers is highly considered in arbitral affairs. These centers consider various applications for themselves within the framework of rules and regulations ranging from &ldquo;offering office services&rdquo; to &ldquo;arbitration process management&rdquo;. With arbitration process management, the arbitration center overcomes problems and obstacles a head of establishing court of arbitration and proceedings and supervises on the arbitrator&rsquo;s activities to lead legal proceedings within specified framework of rules and deadlines. Accordingly, the arbitration centers perform a part of the domestic courts&rsquo; duties in the ad hoc arbitrations. In arbitration process management, the arbitration center takes decisions with judicial nature. Although the arbitration center is not involved at the process of dealing with differences and disputes, but its decisions in arbitration process management have capacity to be outcome-determinative. Arbitration Centre is abided by its own regulations in arbitration process management, but is bond to follow the mandatory rules of the place of arbitration especially principles of fair trial. In case of non-compliance with the mentioned principles, the possibility of a lawsuit against the arbitration center in the domestic courts and the annulment of the decision of the arbitration center and arbitral awards has been predicted in laws.</div> کلید واژگان: مرکز داوری, مدیریت جریان داوری, محکمه داوری, اصول دادرسی عادلانه, دادگاه داخلی.
