fa الگوهای حاکم بر دادرسی اطفال و نوجوانان در حقوق کیفری نوین ایران حقوق کیفری و جرم شناسی Criminal Law تحقیقات بنیادی یا نظری Research <p><br> مطالعه و کنکاش در الگوهای حاکم بر هر موضوعی موجب دسته بندی نظام مند آن موضوع و تبیین بهتر تحولات آن موضوع در سیر ادوار تاریخ خواهد شد. پاسخ دهی به بزهکاری اطفال و نوجوانان بلحاظ روحیه ی ظریف و آسیب پذیر این افراد، سیر تحولات متفاوتی را طی نموده و سیاست گذاری های مختلفی از سوی قانونگذاران را به خود دیده است. با توجه به اینکه، اجرای صحیحِ دادرسی اطفال و نوجوانان، به دلیل اهمیت والای خود، می طلبد که دارای الگوها و روش های خاصی باشد، تا بتوان دادرسی ویژه و قانونی را انتظار داشت، از این رو الگوهای حاکم بر دادرسی اطفال و نوجوانان در این راستا پیشرو، برای دادخواهی و دادرسی اطفال وضع گردیده اند. مهمترین الگوهای حاکم بر دادرسی اطفال و نوجوانان در دنیا را می توان در سه الگوی قانونگرایی، رفاه و مشارکتی مورد بررسی قرار داد و هر یک از الگوها ، همانند سایر الگوها، دارای مبنای خاص می باشند که انتخاب مطلوب ترین الگو در هر کشوری تابع سیاست جنایی آن کشور است. در این مقاله بر آنیم که علاوه بر تبیین مهمترین الگوهای حاکم بر پاسخ دهی به بزهکاری اطفال و نوجوانان در دنیا ، آثار و نتایج مختصر هر یک از این الگوها را بررسی نماییم تا الگوی غالب بر سیاست جنایی کشورمان در ارتباط با بزهکاری اطفال و نوجوانان مشخص گردد.<br> <br> &nbsp;</p> Studying and exploring the patterns governing each subject leads to a systematic categorization of that subject and a better explanation of the developments of that subject in the course of history.
